The Swiss Army Knife is one of Switzerland’s most iconic and famous products. Most people are familiar with the classic red design of the pocket knife known for its quality, functionality, innovation and iconic design, which bears the unmistakable Victorinox cross and shield. In 1884 Carl Elsener opened his first cutlery workshop in Ibach, Switzerland. The name Victorinox is an homage to his mother Victoria combined with the name of the product’s main material: stainless steel, also known as “Inox”. In 1891 Victorinox delivered their first major order of soldier’s knives to the Swiss Army. The Victorinox corporate film introduces you to the secrets of the successful Victorinox company and their famous Swiss Army Knife.

The Classic Limited Edition
Since 2010 Victorinox has been producing an annual limited edition of the small 58 mm Classic pocket knife. The Classic Limited Edition quickly became a sought-after item and impulse buy all over the world: either as a little present or a collector’s item.

Be part of the design and the decision-making process!
Five years ago the company decided to open up the design process for the annual Classic Limited Edition to all designers and Victorinox fans worldwide. Now is your chance again to:

  • Submit your personal design proposal for the next Limited Edition
  • Comment and vote on your favorite designs

A Victorinox jury will then pick a shortlist of ideas that will go into a global voting which will be announced on the Victorinox webpage, their social media channels as well as on jovoto. You and all other Victorinox fans will get the chance to decide which 10 designs will be produced in 2017 and available to purchase around the globe.


The annual limited edition of the classic pocket knife is a popular collector’s item and gift all around the world. The fresh and new designs of the Classic Limited Edition 2017 should again increase the impulse buys and strengthen the Victorinox brand and its reputation of being creative, functional and appealing.

Task Definition

Create an exciting, iconic and unseen design for the Classic Limited Edition of the Victorinox Swiss Army Knife.

Animals of the World is the overarching theme of the Classic Limited Edition 2017. Victorinox wants to see your personal artistic interpretation of this subject.

  • Choose an animal you love and that is typical of your country, your region or your culture
  • Explain what your animal (or animals) expresses: Is your design purely aesthetic or does it tell a story?
  • Be inspired by the visual culture of your origin and by international design trends to create your unique, unseen and exciting design style

Be aware that the Swiss Army Knife of the Classic Limited Edition – also known as “the small Swiss Army Knife” – has its typical small measurements of 58 x 14 mm. Your design will have the strongest visual impact

  • if it doesn’t include too many tiny elements (that cannot be recognized on the small surface)
  • if it plays and fits in with the typical shape – rounded on both ends – of the Swiss Army Knife

You are allowed to submit up to 10 ideas. Please upload only one idea per submission. It’s up to you how you present your idea but you must show the front and back sides of your design on a plain white background in one slide, based on the template.

Target Group

The Classic Limited Edition has fans all around the world in an extremely broad target group between 20 and 50 years old. The buying decision of the average customer is based on impulse, so your design plays a crucial role in this decision process. Since the Classic Limited Edition is sold worldwide, the cultural background of each potential consumer plays a big role.

Mandatory requirements

Make sure you own all copyrights!

  • Only submit designs for which you own the full copyright and image rights. This includes, for example, pictures of celebrities or third-party brands. Since your design should be ready to be produced and sold globally, please do not use any part or element of stock illustrations or stock images.

Make your design ready for production

  • You must show the front and back sides of your design idea
  • You only need to create a visual for the synthetic scales of the Classic 58mm pocket knife. Your design will then be printed on the casing which are mostly in the basic colors of red, white, black, blue, yellow and green and are non-transparent.
  • In this project we are NOT looking for alternative shapes, functions or materials for the synthetic casing.
  • It must be technically possible to produce your design suggestions. An expert team from Victorinox will test the feasibility of your designs.

Use of the Victorinox logo:

  • The position, size and shape of the Victorinox logo on the knife may not be changed.

What you should NOT submit:

  • The shape and functionality of the pocket knife may NOT be changed.
  • Please do not submit design series, but just ONE idea and make sure that your final design is always shown at the top of your submission so it will be displayed in the ideas overview.
  • Show Victorinox your brand new, most progressive and iconic design ideas; designs that were already submitted in one of the previous Victorinox limited design challenges will NOT be taken into further consideration for this project.
  • Designs with any of the following elements will be removed from the project:
    • Weapons
    • Skulls and crossbones
    • Sexist insinuations and any kind of nudity
    • Anything that glorifies violence, hatred or racism

Statement about you: Pick of the Day!

  • Selected Designs will be featured on facebook as the "Pick of the Day" during the submission phase. Please write a short statement (around 80 words) about you and your design and insert it in the upload form when submitting your design! 
  • It is even possible that you upload a short video-statement on the platform. When your design will be picked your statement will be published on the Victorinox facebook page.
  • A statement just like "Hi! I am _NAME_, I am ____ (age), and I live in  (country, city). I work here as a designer since ___ (years). I created this design for Victorinox cause I think ______ (what you think works best about your design – color, idea, style, trend)." 

Required File Format

In case your idea is chosen by the client to be licensed, these are the file formats you will need to supply:

  • PDF format in high resolution (300 dpi)
  • Open layered file format (if possible vector-based)

Here is a brief overview of what is particularly important to be aware of:

1. When entering an idea for a project, jovoto as well as the client, may display, share and print it for evaluation or presentational purposes.

2. There is a three month exclusivity period:

  • in which you may publish and share your idea on other websites or social media and ensure it is clearly labelled as a submission created on jovoto.
  • after which you may offer your submission to others and publicly display it.

3. Please ensure that you have noted any and all third party material you used - including the source where it can be found.

4. When uploading an idea you agree to jovoto's general terms of use as well as the specific project terms (see under the brief).

5. The project terms clarify rights for your upload as well as the details that go into effect if and when you are informed that someone wishes to license your design.

6. Please carefully check and review your submission and the attachments before uploading them - they can only be deleted within 24 hours.

Halftime Feedback

Hi, everybody!

Our halftime feedback meeting with Victorinox went really well! We have received positive feedback on many ideas and they are very happy with the variety and quality of your submissions – keep up the good work!

As you continue working on your ideas, here are some questions to guide you:

Is your design clearly part of the “Animals of the World” theme?
Keep in mind that the theme should be recognizable without description!  

Is you design friendly and inviting?
We’re excited to see a range of aesthetics - just be sure that your artwork will be super engaging with customers!

Do you integrate the Victorinox logo into your design?
The original Victorinox logo is an absolute MUST. It may not be changed in its shape, size, and position on the front side of the knife BUT you may choose any colour if it makes your design more impactful.

Are you creating a special combination of designs on both sides of the knife? Having two sides to work with is an excellent opportunity to feature your creativity - try not to make it too similar or too different!  The whole knife design should be coherent but not identical.

Are your files high quality?
Make sure your files have the required 300 dpi.

Do you own all copyrights?
No stock material is accepted for this Crowdstorm - Victorinox want to see your original designs!

Does your design make a strong visual impact despite the small surface? Remember, if your artwork is too detailed, it loses its effect when it is printed.

Do you only include one idea in a submission?
Are any variations (where you just change colors of some elements) included in that submission? Upload variations of the same idea as new slides to the original (and not as separate submissions).

Finally, do you showcase your personal style?
Whether you are creating computer aesthetics or using analog techniques, put your creativity and heart into it. Go beyond automatically generated, uniform effects - we want to see your special touch!

I also wanted to make sure whether it's compulsory that we stick to animals that are representative for the country we live in. (Although actually I don't mind much, because there are a lot of interesting and beautiful animals living here.)

Hi Ingo! my question is whether one designer can have more ideas with same animals but designed differently - for instance fox and rooster designed differently, different styles(fox and rooster appearing in 3 completely different designs). Is that acceptable?

3 different styles are welcome. If it's a version, please upload all ideas in the slide.

Oh cool! Animals are great :) Is it ok, if an animal is submitted double? For example: One creative submit a rooster and another creative also submit a rooster, but created in another design style? Or should be every sort of animal only submitted once?

I doubt you can limit the use of animals. :) How many entries did we have before, around 1000? That would be a LOT of animals.... I am hoping that people are fair enough to not steal concepts - either technique + animal or unique implementation of an animal. Hope springs eternal...?

If you ask Google ;) "National Geographic lists "bugs" as one of its categories under "Animals." According to Wikipedia, insects belong to "the most diverse groups of animals on the planet, including more than a million described species." Most of these species are insects. Other species of the Arthropoda phylum include crabs and lobsters."

Would it make sense to just remove the entries using stolen work/ clipart/ stock? There will be such a huge number of entries, it would be nice if the screen was not taken up with clipart.

I think the same. This way all projects which are eligible will get more visibility.

Well, that might make voting a lot easier .-). And fairer, too.

But there will be some entries that just ended up looking "stock-ish" although there is no stock material used. How can clip art e.g. definitely be spotted?

And do you think that eligibility (for the client) would also mean that only entries that can be produced/do regard the print specs should stay on screen?

I was only referring to the numerous entries where the clipart link was already provided - and they are allllll there. Honestly, you might as well exclude these people altogether... They just enter more clipart.

makes one wonder why anybody uses stock material although the question if one uses that and the warning that it's NOT to be accepted are nor to miss in the questionaire .-)

I can not delete the old and outdated images of my proposal. I would just leave the latest updates. How do I do that? Thank you.

You can delete slides from a proposal just in the first 24 hours after submission. But you don't need to delete them anyway :) having all your previous versions of a proposal, shows better how your design evolved

Hi Walter, that's correct. But if the picture you want to remove is the cover image, it can't be deleted as long as it's the first picture in the row. Also within the first 25 hours. You can delete a cover image only after you did shift it and did put another picture at it's place.

If you want to delete the whole slide I can do it. Parts of the slides we can not delete. It is better for the client to see how you develop an idea.

I'm really thrilled to see client choosing the ones to be produced! There's not even the half way of the project and Victorinox already have like a entire design library to choose from for the next 10 years!

Hey OldYellow, I have a question concerning the logo. I've created some designs where the art shows through in the negative areas of the logo- would this application be allowed. Or would it be better to enclose the logo in white or another color that would fit the design?

Hi! It is better if the logo are more close to the original. But a special idea can allow different colours. But shape and position is fixed.

Hi OldYellow, at the moment I've got a question concerning the production/print of the knifes. The brief states that "It must be technically possible to produce your design suggestions. An expert team from Victorinox will test the feasibility of your designs." I think that means that ideas that can't be printed can't be a Client's Choice. These knifes are really small,so actually it's a bit hard to guess/figure out, what can/could be printed, technically speaking. Are there any specs or rules of thumb how "big" a detail should be or how thin a line can be?

There is no general rule. It should not be too detailed. I took a look on your desgns. They look great and are definitely printable.

Does the design have to be about an animal in the designer's origin country? Seems like that's one of the requirements when I was reading the brief, but I've seen some artworks don't follow that instruction. I wonder are we free to create any animals around the world and in any combinations. Thanks!

The task is: Choose an animal you love and that is typical of your country, your region or your culture. So you can be born in Switzerland, living in the USA but with parents from India. So if you have a connection to a culture just choose it, no matter where you come from. Just choose an animal and a story behind, what motivates you to create an artwork.

Hi Old Yellow!

I have a question regarding my design "Matterhorn Marmots". In there I am using the "color sliding technique" (sorry, don´t know the English word, it´s "Verlauf" in German), which means f.ex. a dark green fades over into a light green.

Would that be something that is technically not possible for the client to print? Do I have to change the coloring?

Don't worry, it's only the same theme, but in my view you both used different ways of execution! That's because our brains pattern about a lady bug in combination with the knife tools are very similar :) Good luck you both!

It is the first time I have participated in this project and indeed, when I saw the large number of concepts illustrated for the topic Animals of the World I was overwhelmed at the same time excited by the variety of styles and animals, as well as inspiration to everyone sample and, in my case, made me make marks around animals that exist in Mexico. You see I can honestly say that perhaps not among among the best despite having experience in the field of design and illustration, and still have the satisfaction of participating in a most extraordinary and varied project, the perspectives of others good designers and show great interest in professional and personal development that makes us get them as good colleagues. Thank you very much to Jovoto and Victorinox to present a major project that unleashes and motivation to every designer from anywhere in the world. when your overall rating score drops hard, you know someone gave you a very bad rating. My overall rating score dropped by 0.4-0.7 four times since i have entered top 100!

Yes that's the fun part of being in the top 100 !!! Don't worry too much, the monitoring at the end of the project will cancel most of the votes from "Bad" raters !!!

To be honest I do not think a lot about this rating mechanism on our part. I believe that voting and criticisms must be given by the staff of Victorinox ... there is internal marketing purpose. Otherwise, if we vote among us I might say ... could ... be a vote or judgments distorted ... but without malice .... It 'a thought of course not a criticism! :) Ad Maiora Adriano

The voting quote for my designs are round about 40 votes (for the "best") and 20 (for the "worst") from more then 1200 entries and round about 200 -300 designer who designed all this ideas. That are only 16,7% (for the "best"). So the main problem is, if someone has more then e.g. 40 votes for his/her idea he/she has automatically a better rate. I always vote all entries....every time a lot work. Many of the new designer doesn't know how to vote. Some of the other - or maybe the most of the other- have no lust or just no time, or it's equal for them. Sometimes this could be a good strategy to let the crowd push the own designs. I never thought about this fact. It brings me to an conclusion for the next time. Maybe I'm wrong, but in my little brain it cries so loud sorry...and I know that last but not least the client has the decision which design he will take for the final crowd voting.

Hello dear all! I am amazed by so many wonderful designs that I voted so far, good luck to all of us! I am not sure about this task definition in briefieng: "Choose an animal you love and that is typical of your country, your region or your culture", because I saw so many designs that the animal are not from the designer's country of origin...I just realized it yesterday, because I intensified my votes, and when I vote I usually read all the history behind. When I first read the briefing, I researched a lot about typical Brazilian animals that I could draw, because Brazil is my country of origin. Anyway, it was so pleased to see so many beautiful animal designs, they are lovely anywhere in the world.

This is weird: I keep receiving top ratings, but my overall rating is still dropping down :))

Traian that's cos of other factors. While you see top ratings you don't see lower ones. But you can see the overall number of ratings in the very top with other stats. Also as other designs go up or down it effects the overall stats for everyone else. For eg. 8.53 was enough for being 9th but now lets say you have 8.70 and you're 13th. It's all stats sistem Btw-I hate stats! Lol wishing you all the best!

Hahah ahhh! The same case with me! Shortly after I get positive feedback and high rating, total score starts falling. It seems that some people are very active here :) bah! It also happened to me that I got the e mail 'jovotan give you high score rating' two messages but when I look to jovoto newsfeed shows only one 'jovotan give you high score rating' ..and number of ratings still same :> Does that mean that someone is giving a high rating and then come back and change that rating in low? Anyway, I enjoyed this project very much! I enjoyed in all gorgeous designs, I was maximally fair, and I wish you all good luck guys :))) <3 <3 <3

The rollercoaster is always running in these big public project: up & down & up & down...same by me. Thats really crazy to watch.. I think if someone gives a high rating & change it later in a lower rating Jovoto will see/correct it in the monotoring phase. I hope so :) Good luck to you all!

Hey Xavier! :) You have asked for numbers: this is the 3rd in the row of "most submissions ever". Two years ago we had 1352 and three years ago 1318 submitted ideas in the Victorinox projects. This year is also amazing with 1252 great designs! Outstanding indeed :)

Hi there :) The usual rule of thumb for a project is:

  • The ratings have to be checked, only then can the community winners be final and announced. This takes about more or less a week "normally", depending on the size of the project - but still it's quite hard to say. This one was the 3rd biggest project EVER on jovoto and there are 75.571 votes, so as said before, thanks for your patience in advance ;) We're on it to make this happen as fast as possible.

  • For the Client's Choice: the clients have 6 months after end of submission period to decide which ideas they would like to go for. So within that period you will always know. Victorinox will be faster than that though, but there is no set date yet. The Brief also explains how it will go further from here:

"A Victorinox jury will then pick a shortlist of ideas that will go into a global voting which will be announced on the Victorinox webpage, their social media channels as well as on jovoto. You and all other Victorinox fans will get the chance to decide which 10 designs will be produced in 2017 and available to purchase around the globe."

As soon as we have any news, we will keep you informed!

Hi Jovoto! I feel i can't really enjoy my prize there this moment :( argument: My other project "Arctic 2100" was much more popular compared to my winner work if i count all "top votes" nonetheless it is much lower in final ranking. It makes me feel your monitoring has some huge problems. I think your way to show comments publicly is one of the biggest problem there. In my case i wonder 185 ratings to my Arctic project??

Hey J P, maybe more people gave you something around 8 points for Arctic 2100 in ratio to the top votes? So if you have like 50 top votes (just a guess) and many 8 point votes, it ends up around this result...

I dont think the rating system is the best, and the people voting... i dont think all of them understand what they should vote based on project desc. and other factors. For ex: my design got to top100, in 2days after upload with an avg. of 9.2 (something), after that it went into a loop. 2-3days in top100, spent 1day there, rating get big hit, losing like 0.5-0.7 rating, out of top, 2-3days again in top100, after 1 day and again a big drop in rating, out of top and so on for about 3weeks. And i think it's the "people factor"... to be honest, a few of the "top designs" shouldn't even be in the contest.... they look interesting, but not on a 14mm width!!!!! where was this factor taking into consideration at voting?!?!

hi maxim, you did mention the actual width of the knife, only 14, mm and you do wonder about designs that might not work in this tiny size.

well, the brief states that only designs that work in the actual size of the knife will be eligible to win a client's choice. the client will check that when chosing the shortlist for the final voting.

but nonetheless ideas that won't work on the knife or can't be produced can be voted for by the community and win a community prize. we should take the brief and specs e.g. into consideration while designing or voting, the guides often remind all of us to do so ...

actually i tried, but since there were no printing specs attached to the brief it's really hard to figure out if a design really can be produced in the end. no easy task. and i also had the feeling that there are a lot of ideas that use small details or fine structures that might be un-printable.

but it's up to each jovotian if he takes all that into consideration while voting or not. if he or her reads the brief first or not .-)

at the end of the day it's the crowd's decision to chose what they like best ...

well, if I got it right the final ranks are not only based on the average of all votes given to an idea, but there is a "smart algorithm" involved, that also takes into account when the idea was posted and how many votes it got in total. And the average of the ratings given to all the other ideas, e.g. At least that was the explanation given to me by a guide when I myself asked some questions because I wanted to understand how rating (and monitoring) works.

I suppose Dora (or OldYellow) will help and provide further explanation if I'm mistaken or if the procedure was changed.

All the math and monitoring involved is supposed to help to make the voting fair(er). For example to avoid bashing e.g. Or because an idea that is submitted early has got several weeks to collect votes whereas an idea that is posted later might have only got about a week left.

But actually, at least for me, all the math and problems involved into the voting makes it sometimes a bit difficult to understand why ideas got the ranks they have.

And I personally would feel more comfortable with a voting system that's simpler and easier to understand.

You are right. Victorinox is in the process of making a shortlist of ideas they like the most (must be so hard!). Based on the last years if I remember right, there were about 30 ideas in the shortlist.

Those ideas will go into a public voting, happening not here on the jovoto platform, but on their own channel.

So let's wait and see - as I mentioned before: as soon as we have any news, we will let you know!

but i don't think that i'm unfair when i'm of the opinion hat it would have been polite (and fair) to inform crowd (and the finalists) in advance by telling them an exact date.

for me that would be a sign of respect for all those creatives who did invest a lot of work in this contest.

Hi Massiel, thank you for keeping your eyes open. It is crucial for the community that many pay attention. Its often not easy to judge whether you would call it inspiration or copy. Copies are 1:1 or very close replicates.

The idea to take the shape of an owl und present sth within the shape is probably older than jovoto. This one is a tough case to judge. The idea carries several other, own aspects. The owl as well as the object within the change aren't identical.

Please be careful to judge, its maybe a fairer way to speak of "hey someone clearly got inspired". And also even better to reach out to the creative directly before you post publicly.

I am curious to see the forum discussion on this topic - because Jovoto surely cannot claim it did not know. I have reported many of these entries weeks ago (including both owls), some only after the voting became public, and they are all happy and healthy in the voting.

ok... Thats really not good... but this is a public project... I think the clients which are willing to start an open project have also to know, that this could happen. If a client want to be sure to only get selfmade designs, maybe he has to make private projects or better give the designers an official order with a fair and fixed payment. ;)

Oh, Jovoto already knows. Just like the dragon fly is stock, and the tiger is traced from a photo, and the other owl is vintage stock. Did I forget something else? I reported all of them, just like I reported the Owl that started this discussion.

They only started to care when I contacted the copyright holder, who then got involved.

Yes I care about that! I choosed pigs :) I like pigs - and I like the pink color. And pigs are living in my country. ;) AND they look different and have a personal touch. AND they are no stock images. So I think I fullfilled the brief. At least it is a question of taste... I mean the design, of course ;)

Zebra - there is a difference between changing only small details on a stock image and actually drawing this from scratch - hundreds of artists have been able to, people are just taking shortcuts.

Again derivative/ painted over, because believe it or not, not every wing has the exact same pattern. Is it hard to do this originally? Yes. But it is obviously possible. Other artists have succeeded.

Hi Janin, by now I don't quite understand your reasoning – did you use a 3rd party picture or not? The brief did clearly say " 3. Please ensure that you have noted any and all third party material you used - including the source where it can be found."

In the submission form you wrote that you didn't use 3rd party material.

And the halftime feedback clearly stated: "Do you own all copyrights? No stock material is accepted for this Crowdstorm - Victorinox want to see your original designs!"

If I get this right we weren't allowed to use any stock material at all, not even for collages or composings.

The beauty of the internet is that copies and derivatives multiply across sites. So while these may not have been the wings used, they definitely are related to whatever source you did use, otherwise the exact same layout and pattern could not have happened "by chance."

Using a zebra style is certainly not a copyright issue. lets focus on cases that allow to judge between clear copy and inspiration ...

I still think that there is a great difference between the zebra and the owl where the entire design is based on a stolen work and the dragonfly wing which can be replaced with any other one and it won't change the outlook :) Just saying ;)


well, no, basically it's no big difference.

That would be the case for the zebra design, that obviously is the based on the picture you found. I know, all this is hard to understand and sometimes it just sounds picky. Boring and annoying. And some said, well, zebra stripes are zebra stripes.

But even if the design was slightly altered, the use of 3rd party materials can lead to copyright issues. And problems. For examples there have been cases where a big stock agency, that hires very good laywers, did sue and charge fees for an illustration that was based on a photograph found somewhere in the web. They just were able to proof that this photograph was identical with material provided on their website.

And if something like this happens with the design of a knife that is meant to be sold worldwide, licensing can get really expensive. Being sued for not having properly licensed images is even more expensive. So it's a risk to just pick 3rd party material by using google eg.

And that will be the case if the whole design is based on 3rd party materials or not.

I think that's the reason why the brief also states: "Since your design should be ready to be produced and sold globally, please do not use any part or element of stock illustrations or stock images." NO part or element.

That sounds picky, but according to copyrights and the rules for licencing images it definitely makes sense.

Because the case of a collage design like the dragonfly the client just needs to be sure that the designer does own the rights for every part/element of the design.

if all elements of such an collage are 3rd party material, the client is forced to license every picture that was used (even if only a small element, like a dot, structure or splash was used).

So if in the case of the dragonfly, I just don't know if the dragonfly on the front also is clipart/stock/3rd party material, or the splashes and dots. But the client might be forced to license several images if they want to produce that design.

PS. At the moment I'm really shocked that there is so little awareness about copyrights, licensing e.g. To use 3rd party material in a contest where the brief clearly statest that you shouldn't is NOT ONLY unfair. It might cause serious trouble for the creative who uses this material without caring for copyrights and licensing. It might also cause serious trouble for the client, both legally and financially.

PPS: And probably the plattform might also be held responsible, as providing a place where all this happens, and obviously more than once. I'm no lawyer, though ...

Ok, I'm sorry to be in a situation that my entire work has been doubted. The wing I used on the back of the knife was given to me by a friend of mine who is a photographer and told me that owns the copyrights for it, so no legal issues there. In fact I haven't found anywhere on Internet the exact picture he sent me. Still since wings with the same pattern are found at a stock photo websites I replaced it with a dragonfly wing I took a picture myself and believe me or not, you can never tell the difference from a first sight! So if my design get chosen by any chance I can go either way. Best of luck to everyone!

Your friend is a 3rd party. And HE owns the copyrights for that wing he gave you. Only he could transfer this rights to the client. And till now you declared that you didn't use any third party material at all.

That is the reason why your work is doubted by now.

To be one the safe side, you should have taken your own photographs from the start. Nor afterwards.

Each time a jovotian does enter a contest he/she is required to fill in a submission form, and to accept terms and conditions e.g.

In my understanding doing this creates a kind of contract, similiar to an old fashioned contract printed on paper and signed using ink.

And thus a jovotioan can be held (legally) responsible if he/she breaks this contract , its terms and conditions.

To provide data in 300dpi, for example. To provide only artworks the jovotian does OWN all rights for.

And to break a contract isn't only about copyrights e.g. There might be several other laws included.

Project Terms and Conditions:

"5.4 The creative will indemnify jovoto from any claims that third parties may assert against jovoto for infringement of their rights as a result of the ideas submitted by the creative. jovoto will inform the creative of any such assertion in writing immediately. The creative will make every effort to support jovoto in preparing a suitable defense. The creative will assume all costs incurred by jovoto in this connection, including reasonable costs for a legal defense. The creative is entitled to prove that the actual costs incurred by jovoto were lower than those claimed."

One more thing. Why to publish the community voting results before client choice?It was obvious monitoring did not recognize gaming.

The real problem is not who make a unfair design, but is the opportunity stolen from someone who has lost time and money, deserving to occupy that place. Jovoto should take a position, not only censoring those who did wrong, but giving a chance to those who deserve

By now we've got a pretty nasty situation. Unfortunaly not only for those who did play fair and didn't win ... also for those who did play fair and did win ... because by now there is so much doubt and because there are so many questions.

Actually I do suppose that by now almost everybody who did contribute to this contest is wondering, disappointed and frustrated. To be honest: I am.

And I do agree to Tommaso, Fabian and a lot of the things said above: For me it's getting harder and harder to see reasons to be motivated to take part in any new projects here on jovoto. To try to develop an idea that is on brief, from scratch, that has a "unique, unseen and exciting design style" and a "personal touch" is hard work and does take a lot of time. Everybody who takes part in contests will be aware that losing is "part of the game". But I do think that I'm not the only one who thinks that is easier to accept losing and be a "fair loser", a "good sport" if one has the impression that the contest was fair, according to the brief and rules ...

I tried to not air any of this publicly. I reported scores of entries to the guide, who... did nothing. I offered to look through the Top 30, because I do a LOT of these copyright checks. I reported more entries after the voting started.

And basically, I was told (in the case of Norman's owl and the tiger) "yeah, we told Victorinox, and we are all fine with it."

Only then did I contact Norman and other artists that their work was stolen. And funny that now oops, it is a problem. It was a problem before, they just hoped no one would notice.

And for full disclosure - I was accused of copying. In none of the cases, I see the point - the worst you can accuse me of is not being the first to do a bear, sea gull, or cat ying yang...

well, that might be one of the core problems in here. jovotians are supposed to be a nice crowd that's happily "crowdstorming" together. that's the vision.

but at the end of the day/each project (=contest) there are a few that are chosen to be winners, to get some money and "fame".

a jovotian is meant to be a happy crowd member, sharing and helping, having fun e.g. but at the same time he or she is part of a very competitive contest.

Dear Fabian, Pinstripe & everyone,

We did get in touch with the client about CrossTheLime's reported designs (thank you CrossTheLime for your impressive investigative work!!) and it was the client's choice to keep them in, because there is a fine line between 1 to 1 use and inspiration of artistic material.

Which brings me to the point that, although we ask in every project several times throughout the process if it's your original work, it is the creative's legal responsibility to use and state the material to which they have the rights to. So our advice to you is to not take that chance and to always do original work and/or mention the copyright pieces that you've used.

That being said, we want to do the best we can to create a safe place for you on jovoto to create original work, and we are embarking on processes to react quicker and better to copyright issues. And your support is helping us to do it in the fastest and smartest way. So, please, in any project on jovoto, if you see copied work, report it to us asap.

At the moment, when uploading your work, we ask you if your work is 100% originally yours. But if work is inspired (even traced) from another image (which technically is not 1 to 1 copy), what do you think would be a more accurate statement when uploading an idea, to ensure original work from each creative and that all inspiration is stated?

Hey Diana..I think you could add a menu to specify what kind of technique is uses (collage, hand made drawing or computer illustrations). Also you could request some screenshots for the developement process (that will improve the quality of the submission for the client too).

Some light punishments for copyrighting in this type of contests (like the ones for bashing ) will reduce the frequency of this events.

I'm not against creativity but this kind of events hurt the reputation of the platform...

perhaps a kind of tutorial about copyrights, stock material und the rules of use could be a start. At least for those community members that are inexperienced and really don't know about these things. Who think it's ok to pick pictures where ever you can find them without any second thought. Wo don't know what stock material is, and how to correctly use it. What "tracing" is.

Who aren't even aware that use of stockmaterial or other 3. party material might lead to serious legal trouble for themselve or the client, if it isn't licensed and paid for

It won't interest those who just don't care, though.

But what happens when someone is obviously not telling the truth at this point? There must be consequences in my opinion. Even if copyright laws are not affected because the age of the work these works are off-brief as they are not original. Perhaps a detailed explanation how thick the thin line is would be helpful at this point ;) I wonder that Victorinox is ok with that as licensing these works could end up really unlovely...

thanks for your feedback. Gosh, these are very thin lines we're treading here.

Actually I just read a brief where the entrants simply get a entry form where they just fill in or copy and paste to show the material they did use/get inspired by.

In regards to "traced" images I've got one more question. If I remember it correctly, at art school we were told that if we use an image to alter it or trace over, it e.g. this still will infringe copyrights of the "urheber" (owner) as long as original image is clearly recognizable as the origin of this "make over". And that the "urheber" could sue us for the use of this material. Well, this refered to Germany and maybe the copyright laws were altered since.

Would be good to know, anyhow.

Just wanted to add a comment here, that I think out of respect for the community members, if you discover a copyright infringement, why not send a private message with your findings? In the defense of Jovoto, it is almost impossible to discover all the possible copyright infringements in illustration work, because you can also infringe by stealing someone's style, not just their direct work. Unfortunately there are people who cheat, whether intentionally, unconsciously or because they have gotten away in their school practices with tracing images from the internet and have developed bad habits in their creative work, but I think out of respect for even those who may be infringing, keep it to a private message so as not to incite the anger of the community. There are a lot of people who are not happy with the outcomes of contests, but the community only has as much integrity as what the members bring to it. If you actually aren't even sure what constitutes copyright infringement, this is a pretty good overview, although I suppose it varies from country to country:

As creatives in this golden age of technology, I think we are all guilty of spending too much time on the internet seeing what's out there rather than working on developing our own unique styles. It's great to find inspiration and see what's trending, but clients are here because they want to tap into our inner creativity. We all have styles, artists and designers we admire and look up to, but we each have to forge our own paths as graphic designers and creatives, and it's hard to do that when we have the internet as a reference to rely on. Close your browser, get out a piece of paper and start with your imagination, and trust that you probably have better ideas than what you find on Google!

for example of the community winners during the monitoring or the probable client's choices? Perhaps plus some runners up for the case that there are ideas that fail these check?

Yes you are definitely right, there should be an effort to check the work indeed! I guess I just mean that it's impossible to catch everything, because there are multiple ways to infringe besides direct copying, and that it's good for the community to also keep each other in check if they see something. But I think it can be done in a way that is private so as not to embarrass or shame others.

Even if you’ve modified or combined it, please know that in this project no stock material is accepted." ... to my mind, this makes the line between "1 to 1“-copy and "inspiration" quite clear. It's one thing to be inspired by an artwork and create something alike, but another one to really take identical parts and not mentioning it - 1:1 silhouette shapes from other artworks, complete stock illustrations o.e.) … that - to my mind - is „third party material“. So concerning everything „crossthelime“ and others wrote yesterday, I have the impression that the problem has two aspects: the first one is people using other peoples work without telling about it, but the second one, which surprised me a little: Jovoto and the client excepted these entries although they got informed about stock-material used (and we see examples here, where I wouldn’t talk about a „thin line“ of inspiration or copying … and it is clearly said „no stockmaterial“...). Apparently Jovoto got informed „behind the scenes“ as well as in the comments, where Massiel f.ex. remarked that owl before submission was closed (so he did contact the designer first, as recommended in the discussion above - but it did not help) The question for me is: what does Jovoto want…?: leave the decision to the client, when the client doesn't mind, that there is 1:1-third-party-material within an artwork - even if he is told. Or be strict with the contests rules and contact the designer who entered the proposal and encourage him to change it (in this open process here they would have had that chance - must be a very bad situation for them now as well …). As we can see here, it turns out awkward, if this part of „insisting on the rules" is left to community members (... a little strange, that judging and observing each other anyhow …) … best, Karen

Hello Polygon, I see where you are coming from. It really is a shame to imply statements when you have no evidence. I understand why you would say a thing like that, the thing is I did the illustration myself for the owl and the plants with hand and paper, and I have all the evidence and the PSD files. For the plants illustration I am aware of the vintage elements seen above, because I did a research for my illustration to get a reference. And all that images were used merely for reference and inspiration. I appreciate the research all the community is doing to protect the artists copyright, and I'm on your side. But it would be a smarter move to contact the author directly to confirm the facts before releasing statements that degrade the author's work without complete knowledge of the situation.

That ones is difficult, as it is clearly against Jovoto and project rules, but not against copyright laws. Makes a mockery of anyone actually sticking to any rules, but hey - oh, and I checked... that one, I reported on October 3rd, and Jovoto was going to "look into it".

If I just add a little footnote to this discussion; While it's kind of a gray area to use existing images and make a collage - They're still no one who holds the copyright for those images. Walter Hood Fitch died in 1892, which is more than 100 years ago, ergo: His work is under public domain.

and even if work is under public domain it's quite usual to give credit to the author, dead or not .-)

Well, does anybody in here know more about public domain? I'd suppose that even if we are allowed to use such materials, we wouldn't exactly "own" the rights for this material. And I'm also not sure whether all work of an artist/designer eg. who did more than 100 years before will be public domain. (Sometimes there are heirs who secure the rights.) And is art/artwork that belongs to a museum/collection/library eg. public domain?

The issue "public domain" is really interesting. And there are severel sources in the web where one can read about the laws and rules for public domain.

Unfortunately these seam to be different in different countries, the US handles public domain differently to Europe, Germany, France e.g.

And there have been several cases where copyright holders did refresh/renew their copyrights before these did expire.

To assume that the work of an artist wo died about 100 years ago might be public domain material is a pretty good rule of thumb. But still on might have to check if one is really allowed to use "old" artworks.

See for example: "As rights are country-based and vary, a work may be subject to rights in one country and be in the public domain in another. Some rights depend on registrations on a country-by-country basis, and the absence of registration in a particular country, if required, creates public domain status for a work in that country."

And there is one more thing: The concept of public domain material is that the PUBLIC does OWN these materials. Any one may use public domain material, but nobody can OWN it.

For this competition we had to confirm that we do OWN any and all rights for all the artworks we submitted.

Cross the lime was absolutely right when she wrote that even if these "vintage" illustration might not cause copyright issues it still is against the the terms and conditions of this contest to use them.

@Gonzalo: WTF?!?!? "the thing is I did the illustration myself for the owl and the plants with hand and paper" you forgot to mention that the paper was siting on a screen with that picture opened!!! i dont think its a coincidence that every little dot is the same....

BTW: And I would rather not trust every website that does advertises "free illustrations". They often aren't copyright free but put into the web by somebody who doesn't know much about copyright...

I now feel bad for the 2 weeks I've spend developing an unique concept, handcrafting original illustrations for any single element of my design (and there are a lot of them, check my submission) and tracing them in the computer just to fond out that is ok to take a design of an great artists (eventually dead so it can't claim any copyright), then change it so it don't match the original artwork '100%' . That' s not even art ... Anyone with something basic knowledge in photoshop can do that in less than 5 minutes. I mention again, I've worked 2 weeks on mine even if I have school and a lot of studies to do and I've got only the 390 place.

Now that the contest is over I invite you to check my ideea. I want at least to have the feeling that some people could enjoy my art in return for all my hard work :(

Of course people respected and liked your idea. 390 place out of 1293 is not too bad, that's like in the top third of all entries. Also EVERYBODY has other things like school and jobs and life going on, and they also put in the a lot of hard work on their designs. You can feel good that you had the integrity to do it right. So keep it up!

The point is that as a beginer artist I struggle more to create original art. Is very dissapointing to see that some of the more experienced users here manage to exploit some gaps in the jovoto system in order to earn prizes more easily than the newcomers. Until now this issue with the copyright and the vote trading based on the popularity on the platform are the biggest problems of this site, and the factor is that the developers can't do anything about this issues in the given situation.

I'm a begginer artist too and I've worked lot of time in my design and I feel the same, because is pathetic that a a person in 5 minutes can create a design using work of other and a little photoshop. Also, I love your design, is very original, colorfully and funny. I want to participe the next year in this project and I expect that your design and mine will be better valued. Good luck :)

Hi there, I wanted to handle it descreetly and mainly behind the scene.

But you might be interested to know that I just informed the guide about another victorinox entry picked for the final voting that obviously used stock material without providing any information about this. (Perhaps it's even two, but the second one isn't that obvious and i left it to jovoto to check futher or not).

Well, if this project proved anything, "quietly and behind the scenes" does not work well with Jovoto. Neither does any public discussion during the project, because any comment that does not say "wow beautiful" will result in bashing. And we aren't being paid to spend time policing the site...

I am basically stumped what does help. Honestly? Wait for whichever entry wins, then get the copyright holder involved, let him start a shirt storm and take legal steps, and make this expensive and embarrassing.

well, this might sooner or later happen the other way round. stock agencies e.g. are well aware that people are tempted to nick their material.

and at least some of them do mark their material with watermarks and digitally e.g. or do use softeware to browse the web and find out where their images are used.

It is so sad to see the turn of events for this contest, it bother me to realize that people are selected for the final vote while their design are copying paste work from elsewhere ... but that does victorinox and jovoto! ?

I spend hours finding and photographing Swiss wild animals then I cut them off and work computer and then put in associate in a design composition for this contest while others in three click to copy the design of creative real and d 'Illustrator and we put for their project in this contest and that in addition they are selected by the jury for the final vote ... The owl and the floral elements are exactly as the vintage pictures. In your entry description you even say you did not use any 3rd party materials which is a lie! I do hope that Jovoto and Victorinox take action otherwise the rules are a joke.

In view of that issues I would like to hear a direct feedback from Victorinox. I can't believe that they don't care about that. They also have their principles and code of Conduct. So lets hear what the client say. I think it would be great, if only proven designs with clear copyright owners enter the final voting stage... And there are a lot of those designs in this contest. Maybe Victorinox should not using Facebook for their voting - they can give their voters the direct link to jovoto project site. ;)

I appreciate the "live" discussion we have here. We collect all your thoughts and tips how to improve ourselves in the future in ways of the briefing, our feedback and in the final phase of the projects. And while we are at it, that would be my request from you, to continue with it in a constructive way. I see and understand the frustration and disappointment from some of you and hope you can take the weekend to let it go and also give us time to solve it.

The frustration springs, i think, from the fact that you step over your word with the jovotans in favour of the company, and consider it just a tiny procedural bug (like in the lunchbox for adidas contest) easily fixed through well placed PR moves, replies, but don`t actually try to solve the real problem. This cannot happen anymore, the world is waking up to all the junk in society. No offense, but we do the real work for the companies, and we don t like being neglected and lied about deadlines, or the "game" to be unfair. The best way to get over this, and also the fairest, would be to publically admit you failed, drop some real excuses and some payments. Also i suggest in the future to make a small section with little gifts for all the jovotans which come with at least one realist, doable, oroginal idea, could be like a Jovoto logo t-shirt or something. Start being fair, stop using the CORPORATIST way of dealing with things, and start incorporating COMPASSION,

Ok people, I don't mean to stir the pot but we've all been so concentrated on this year's entries we forgot to see that the problem strats way back at the begining of the contest at 2012 where one of the chosen 10 designs is a simple stock image: And if you look underneath, there are comments about it. As I get it right the company pays off the creativities through the community voting and get what they like for their voting :/

@ vlad_ooo: this might be slightly different. in 2012 the brief did not mention that stock material isn't allowed. this year this was made very clear, explained and repeated several times.

but you're still right, the problems with use of stock or 3 rd party material isn't a new issue.

last year took part in a competition where 3 rd party material was allowed, if it was possible for the client's to license it. we were supposed to provide the informations and links the client would need to license 3 rd party/stock material.

there were several entrants that didn't even bother to fill in the entry form. the lines where they should state whether they did use third party material and where it could be found were left blank. nonetheless these entries did stay in the contest.

and some of them did win, and even were cc in the end.

well.... where there is more than 1 human being, and especially when money comes into play... we tend to screw things up. I dont know why out of all animals in the world, most people just picked cats & dogs!?!?

We’d like to thank you for holding high standards, making this discussion happen, and keeping it a priority. The use of third party material, and how we handle it is imperative to creating the fairest workplace for creatives.

In regular Crowdstorms it is common that creatives can use third party material to illustrate their idea as long as they clearly mention the material and its source. In the particular case of the Victorinox Limited Edition it is not: Victorinox only wants to see designs uploaded that the creative owns the exclusive rights for.

What we learn from this discussion is that not all creatives - and not even all clients - have the same idea about “third party material”. While some consider even a vague resemblance of a visual to an existing one as “stolen”, others believe that they created an exclusive visual if they reconstruct an existing design as “their own” vector-graphic.

We had an open and constructive discussion with Victorinox. They decided to take two further designs (Owl in Nature & Counting Sheep) down from the public voting because the application of the material is too close to the submitted idea, but they didn’t feel is the case of other submissions.

As said: We thank you for bringing up this issue and will work on a better and common understanding on “third party materials” amongst the designers on our platform, ourselves and our clients. Thank you again for raising awareness.

I asked the same question one week ago. But I think it is too late now. The voting process is almost done. And at the end there will be only 10 designs. It is a pitty! There could have been 3 others designs in the contest, if this problem of third party material has been solved before... :( :( :(

Oh sorry, I have been informed that I mistyped. Not only 3 designs - there could have been 6 other designs in the contest... Or more. Who knows? Only the design owners know the real truth. And if someone who has cheated by designing - not matter how - can not be proud in case of winning this voting. Because the rules were fixed before. Everyone knew. Good luck dear honest designers :)

As Ramona mentioned the voting ends in 1 week, and it isn't possible at this point to add designs to the vote. The 10 final designs will be selected from the designs that are currently in the running.

Agree to Ramona: Let's vote for and keep our fingers crossed for those honest & fair designers who are still in the run.

One week is nothing much, but, it is all we needed! If any replacements, which is best enough to be among the voting and meet the rules, why not give the these design another changes again? I think many of us still dream about our design becoming a real product! A week still good enough for our dream. No regret, because we had try our best to advanced into the final voting phase! Even thought we lose the voting phase, we still happy that we had made it to the final voting phase.

today was the last voting day to vote in Victorinox’s site on the Limited Edition 2017. We are very excited for next week, with the announcement of the 10 Winners for this year!!!

The discussion on the final design list lead to a lot of discussion and we are very thankful for it. We were in touch with the aforementioned Creatives, and have received official statements and relative work materials.

We were also in close contact with Victorinox and they have provided the following statement: "Victorinox has been informed about the use of third-party materials in this contest and is taking it very seriously. Victorinox and jovoto checked all of the designs in question and gave the designers the opportunity to make a personal statement in response to the complaints received. Due to these statements, only 32 designs remain in the voting. Blatant copies have been removed. For next year’s competition, Victorinox and jovoto will clearly define the guidelines for the use and inspiration of third-party materials so the situation is clear and everyone is on the same page. Victorinox would like to thank all designers for their passion and the numerous submissions and we’re looking forward to a wonderful and varied Classic Limited Edition 2017!"

As Victoinox mentioned, next year we will make extra precaution to avoid a similar situation. Currently we are working on our briefs, couching our creative guides and setting better standards to make our Crowdstorms more clear and precise.

Project terms

The following Project Terms are the legal basis for your participation in this particular project.

In §3 we define the rights that you pass on to jovoto when you submit an idea (for example, you may publish and share your idea on other websites or social media but ensure it is clear it is a submission created on jovoto).

In §4 we define the rights that you pass on to the client (for example, that the client is allowed to evaluate or review your ideas in order to help them make their decision). From §4.2 onwards, you find the details about which rights you pass to the client once the project is completed if they decide to license your idea.

In §5 you will find important points on what you will be held responsible for (like respecting copy rights and clearly marking all third party material in your submission).

Project Terms for the "Your Swiss Army Knife 2017" Public Project

1.    Scope

1.1    These project terms supplement the Terms of Use for creatives and apply to public projects in terms of section 3.1.1 of the Terms of Use. Definitions contained in the Terms of Use also apply to the context of these project terms. Public projects may be viewed by everyone. All registered creatives may submit ideas for such projects provided they accept these project terms.

1.2    By submitting an idea to the project, the creative accepts the terms of use and these project terms.

2.    Right to be Named as Author

By accepting these project terms and the terms of use, the creative waives any right to be named as author if the client wishes this when licensing the creative's idea. As long as the client does not purchase the idea, jovoto will ensure that the creative is named as author.

3.    Granting Rights of Use to jovoto


By submitting an idea to the project, the creative grants the rights of use listed in section 3 to jovoto.

3.1    Even when participating in a project or submitting an idea, the creative still retains the right, without restriction on content, time or space, to use his own idea for the purpose of self-promotion provided he observes the rights of third parties, in particular those of the client. This does not apply to the first six months following the end of the submission phase of a project. During this period, the creative is not permitted to use his idea in any other manner. The client's trademarks and other related rights may only be used if and when the client explicitly allows this for the performance of the competition. 

3.2    jovoto wishes to point out explicitly that participation in a project and/or submission of an idea does not confer on the creative any right to use material of jovoto or the client. In particular, participation in the project does not give the creative any right to use the logo or other materials belonging to the project sponsor (client) or to third parties. This does not apply in cases where the project terms or the project briefing call for other arrangements.

3.3    The creative submitting an idea to a project grants to jovoto non-exclusive transferable rights, without restriction on time, space or content, to use the idea, including associated creative works and any comments submitted therewith to the extent required for the operation of the platform. In particular, the creative grants to jovoto the right to make every comment and/or idea and the associated works on the platform accessible to third parties and to make any reproductions necessary for this purpose. The creative grants to jovoto the right to edit the works in question in order to present them more favorably on the website.

3.4    In addition, the creative grants to jovoto the right to make comments and/or the idea and the associated works publicly accessible for the purpose of presentation beyond the confines of the project, for example in the jovoto newsletter or in its blog, to distribute them and to edit them, in particular to create and present summaries or individual pictures of videos and texts, scaled-down versions of photographs ('thumbnails') etc.

3.5    Furthermore, the creative grants to jovoto the non-exclusive right, without restriction on content, time or space, to use the ideas and associated works in any medium for the purpose of communicating and promoting the project and/or ideas submitted to the project. To this end, jovoto may reproduce the ideas and associated works, distribute, edit, rearrange them, make them publicly accessible, broadcast and publicly play them in other ways, whereby this includes in particular making them available or broadcasting them by transmitting the content to fixed or mobile terminal devices of other creatives as part of automated subscription services (push services) or download services (pull services) (e.g. by podcast, RSS feed, Atom feed, XML interface or other technologies). The parties to this agreement consider the right of public reproduction also to include, in particular, the right to render the idea and associated works on the website using methods to play back audio and video data that can be received and simultaneously played by creatives (streaming), including the possibility of configuring the stream in such a way that the broadcast data can be stored by the recipient. In order to document the project and/or to promote the platform, jovoto may in particular include the creative's idea, alone or together with the ideas of other creatives, in a catalog of ideas, which will be made available to the client on conclusion of a project, and which it may reproduce as a different form of print publication and distribute (including as poster), where this serves as an appropriate form of publication for the platform, present at trade fairs (in particular in the form of banners, posters, video clips), make accessible as "best cases" on the platform, also in conjunction with other projects, or make generally publicly available, include in press releases or make available to third parties in the course of normal public relations work (for example for external press reports in journals).

3.6    In order to secure the greatest possible level of awareness and reach for the creative's ideas, the creative additionally grants to jovoto the right to publish the creative's ideas, and/or to have them published, on websites of external providers, to make the reproductions required for this and to transfer the individual works (i.e. the corresponding files) to the relevant third party, and/or to grant these providers technical access to the ideas for the above-mentioned purposes, including the right to reproduce the ideas for inclusion in their own websites. In order to achieve the aims mentioned in this sub-section, jovoto may use popular, established technical methods (e.g. embedded functions). The creative therefore consents to the relevant third-party provider adopting the works in question and also publishing them.

3.7    The creative will receive no monetary recompense for granting the aforementioned rights of use to jovoto. In return for being granted the rights, jovoto will present the creative's ideas on the platform and will give him the opportunity to sell his ideas to third parties or to jovoto and to participate with his ideas in projects.

3.8    In technical terms, the platform is a highly complex system with a large number of links. The content of creatives builds on from different user content and is cross-linked with it in many ways, etc. In addition, as a platform for creative services, the platform must provide a high degree of transparency and traceability – also covering the possibility of investigating or searching through events set in the past. The granting of rights of use in accordance with section 3 is therefore irrevocable and extends beyond any end to the user agreement. Content submitted by the creative to the platform can therefore remain accessible on the platform even after this license agreement terminates or the creative is no longer a user of the platform for other reasons.

3.9    jovoto also endeavors wherever possible to allow the creative every freedom to exploit his ideas vis-à-vis third parties. Within the scope of projects the creative may, where applicable, have the opportunity to subject his idea to open content licensing terms (such as Creative Commons licensing). Whether and to what extent this is to apply in an individual project (including the relevant details) will be specified in the briefing. The creative must in all cases explicitly indicate the use of third-party materials, including those that are subject to open licensing.

4.    Granting Rights of Use to the Client


By submitting an idea to the project, the creative grants the rights of use listed in section 4 to the client. The granting of rights of use in accordance with section 4.2 ff. is subject to the condition precedent that the client decides to acquire the creative's idea.

4.1    By participating in a project, the creative grants to the client the non-exclusive right of use, without restriction on content, time or space, to present his ideas and works as such outside of advertising campaigns or in order to promote the project, alone or together with the ideas and works of other creatives participating in the project, in any medium. Moreover, the creative grants to the client the right to use the ideas and works for the purpose of internal and external market research and for preparing the acquisition of the exclusive rights of use to the ideas and works. This may require the distributing and making the ideas and works publicly accessible, limited to the aforementioned purposes.

4.2    By accepting this license agreement, the creative grants to jovoto, subject to the condition precedent of the client's decision to acquire the corresponding rights from jovoto, rights of use to the idea that the creative has submitted to the project, together with all works, performances and activities contained in the idea, and to elements protected by copyright, design and performance protection rights associated with the idea (hereinafter referred to collectively as "works"), for exploitation in all known and unknown manners of utilization, in particular to the extent detailed below. This includes in particular – also in cases where rights arise at a later date – the exclusive, transferable right, unrestricted by content, time and space, and capable of being sub-licensed in parts, to reproduce the idea, and all works, performances and activities contained in the idea, irrespective of whether for payment or not, to distribute them, exhibit, rent out, to publicly render, in particular present, perform, display, make publicly accessible, broadcast, relay via cable or other systems (cable rebroadcasting), reproduce through video or audio medium, to make public via screen, loudspeaker or any other technical device, programs already broadcast or recordings made on the basis of public transmissions or to reproduce in any other intangible form, to edit and rearrange as well as to publish and use any such edited or rearranged form.

4.3    The aforementioned rights of exploitation for commercial or promotional purposes include in particular:

4.3.1    The right to reproduce the idea, and all works, performances and activities contained in the idea, in any tangible and/or intangible, digital or analog, form, e.g. through reprography or transfer to analog media (e.g. packaging, promotional material, advertisements, placards, books, stickers, printouts, pictures, illustrated books, books, comics, leaflets, flyers, photographs, photocopies, photo-mechanical processes, posters, magazines, newspapers), through digitalization or any other form of digital storage and to temporarily and/or permanently store on any other known type of data, video and/or video/audio media such as diskette, DVD, DVD-R, DVD-RW, DVD-RAM, HD DVD, Blu-ray Disc, CD-ROM, CD-R, CD-RW, CD-Audio, Super Audio CD, audio cassette, vinyl record, MMC, SD, MS, MS Pro, Flash Card, Smart Card, Secure Digital Card, memory stick, MiniDisc, DAT, hard disk, server, proxy server, USB stick and/or via transmission in the Internet or other data networks or through transmissions or in database systems; in particular this also includes the right to use the idea and all works, performances and activities contained in the idea for company-internal and -external presentations, in company-internal media such as intranet, PowerPoint presentations and for the creation and distribution of advertisements in print media and in electronic, especially online, means of advertising;

4.3.2    The right to distribute or put into circulation the idea and all works, performances and activities contained in the idea in any known way and on all physical analog and digital media independently or in combination with other works, especially in support of a product, and/or to offer these to third parties, in particular to rent and lend out irrespective of the distribution channel and the embodiment, in particular through distribution of the idea and all works, performances and activities contained in the idea on the aforementioned digital or analog media via wholesalers, resellers or retailers, mail order and irrespective of whether by remote sale, electronic transaction, free transfer or free distribution;

4.3.3    The right to transfer the idea, and all works, performances and activities contained in the idea, in any known technical manner and to make them known, and in particular accessible to the public. This includes, in particular, the fact that the idea and the associated works may be stored in digital form in a data processing system from which they may then be retrieved by third parties 'on demand' as a stream or download or any other form as digital signal via wired or wireless media and/or transmitted there with the consequence that the stored data are transferred to the receiving device of the third party where they may be decoded after storage, intermediate storage or immediately, i.e. converted into text, images and/or sounds and made visible or audible. The idea and the associated works may also be made available to the third party in such a manner that he/she may store the idea and the works contained therein and/or parts thereof in his/her receiving device and may access them there repeatedly. Interactive use by way of on demand is characterized by the ideas stored in digital form being made available to members of the public who are not present at the source of where they are made available, and being made available in such a way that members of the public have access to them and can request their transmission at independent times and places even if transmission of the works to third parties takes place at a later point in time than at the one requested. The online right of use exists independently of the form of transmission chosen by the client or its licensees for the use of the protected material and includes, for example, interactive or non-interactive online systems, electronic databases, the Internet, the World Wide Web, social networks and platforms such as YouTube, Twitter, XING, Google+, LinkedIn or Facebook, Apps, IRC or news, file sharing or application service providing;

4.3.4    The right to send or forward the idea, and all works, performances and activities contained in the idea, to third parties irrespective of whether in 'analog or digital' form whether via data networks in the form of subscription or download services (e.g. by streaming, video-on-demand, near-video-on-demand, podcasting, webcasting, simulcasting, IPTV, mobile TV, push services (such as RSS feed, XML interface, etc.) and pull services of all kinds) or via traditional modes of transmission such as public or private broadcast, rebroadcast and repeat broadcast via radio, television and similar systems of communication and reception, electromagnetic waves, electronic devices, wire, cable, satellite, antenna systems, digital means of communications and other technical equipment, whether via the client's own means of transmission or via public or private broadcast companies;

4.3.5    The right to publish the idea, and all works, performances and activities contained in the idea, first in any desired form at the point in time of the client's choosing irrespective of whether on any type of tangible media or in intangible form (e.g. on the Internet), irrespective of whether independently or in combination with other content such as a collection or multimedia work or as part of an encyclopedia;

4.3.6    The right to commercially exploit the idea, and all works, performances and activities contained in the idea, through the manufacture and sale of goods of all types (e.g. dolls, toys, stuffed animals, sports articles, household, bathroom and kitchen items, garments, printed matter including comics, sound storage media, headgear, buttons) and/or to exploit the media listed and described in this sub-section, the marketing of services of all types using the circumstances, names, titles, figures, illustrations or other relationships related to the idea, and all works, performances and activities contained in the idea, including the right to exploit the idea fully or in part through the production and sale of games/computer games, including interactive computer games, and/or other multi-media productions and/or other forms of work and to promote goods and services of any kind using such elements or through edited or unedited excerpts from videos ("merchandising right");

4.3.7    The right to modify, edit, combine, arrange the idea, and all works, performances and activities contained in the idea, in any manner, especially through correction and translation into any other language, through extension, conversion, augmentation, adaptation, complementing, through inclusion in databases or by the creation of collected works, through the substitution of images and figures, through changes to the characters of figures, or allowing such actions to be undertaken by third parties, and to publish, exploit, or have published and exploited, the edited or rearranged works in any of the ways described in the above provisions.

4.3.8    The rights granted exist irrespective of the technology used as the basis for the use of the right. In particular, the granting / transfer of rights of use are not bound to the form of data transmission (analog or digital), to the means of data transmission currently used or to the type of end-user receiving device. The client is especially entitled to allow this access via any type of equipment or device that is technically able to call up and/or represent the content provided. Access can be effected in particular with the aid of fixed devices (e.g. personal computer, set-top box for digital TV or Internet terminal) and mobile terminal devices, especially mobile telephones (via WAP, SMS, i-mode and any future standards), smartphones, electronic organizers, so-called personal digital assistants (based on operating systems such as Stinger, EPOC, Palm OS, Windows CE/Pocket PC), in particular via wired connections (telephone networks, TV cable networks, ISDN, DSL, Internet fixed line, etc.), via wireless connections (wireless local loop, satellite, radio [in particular DVB-H], mobile telephone networks [GSM, CDMA, HSCSD, GPRS, 3G, UMTS], wireless LAN) or in the process of synchronization with other electronic devices (e.g. via cable and network connection, Bluetooth or infra-red) and on the basis of various transmission standards and presentation formats (e.g. TCP/IP, SMS, MMS, EMS, PMS, smart messages, DVB, HTML, WML, cHTML, e-mail) in all online services, data and (tele-) communications networks, in particular the Internet.

The client is to be able to use the idea fully and exclusively on a permanent basis and to exploit it commercially, in particular for advertising purposes and across all media.

4.4    In addition to, and above and beyond, the above provisions, it is agreed that, if the creative has created a computer program, only the client will be entitled to exercise any proprietary rights to the computer program after the transfer of rights by jovoto.

4.5    Following the transfer of rights, the client is entitled at its own discretion and without the separate agreement of the creative, to transfer the rights listed in section 4 to third parties or to allow third parties to exercise such rights irrespective of whether in the original form or in an edited form. This applies independently of the content and scope of the license terms agreed with the relevant third party, i.e. irrespective of whether through the transfer of the exclusive right of use or through the assignment of individual or several fully inclusive or non-exclusive rights of use limited with regard to content and/or time and/or space.

4.6    The above provisions also apply in the event that the idea, and all works, performances and activities contained in the idea, have been combined with third-party protected material. If a collective creative work with shared copyright ownership has resulted from the combination of the works with other protected material, the creative herewith agrees to the exploitation of the collective work to the extent specified by the above provisions.

4.7    The use of material covered by open access or open content licensing terms for the development and creation of the project idea is prohibited, irrespective of whether this is done by the creative or third parties. The creative warrants that he will not use such material.

4.8    The idea will also remain visible on the platform even after being sold to the client. It will however be marked as 'sold (e.g. as 'Client's Choice').

4.9    The creative waives his right to be named as author in the exploitation of the idea. jovoto will work towards persuading the client that the creative's authorship should be acknowledged as author and that he should be named as such in accompanying material in cases where it is not possible to achieve such mention on specimens of the work.

4.10    Where the creative has used material and/or works of third parties in the course of developing and submitting the idea (for example photographs from publicly accessible databases, fonts, sample texts or similar), he also grants to jovoto and to the client rights of use to this third-party material and to these third-party works in accordance with the provisions of section 4.10. The sole exception to this are those parts of the idea that have been identifiably used for illustrative purposes and are marked as such components used solely for illustrative purposes and are explicitly titled as "SAMPLE" or "SPECIMEN" in the idea. Third-party materials and third-party works that are not marked as such will be treated as if they were the creative’s own works.

4.11    The condition precedent for the granting of rights in accordance with section 4 will be deemed to have been met when the client has made the decision to acquire the rights to an idea of the creative as specified in section 4, the client has informed jovoto of this in writing and jovoto has accordingly informed the creative in writing. jovoto will grant the license rights to the idea to the client immediately after the condition precedent becomes effective and the creative has been informed.

4.12    jovoto will immediately inform the creative in writing in cases where the client desires a direct license of rights from the creative. The creative and the client can then reach an agreement on the scope of the rights granted – if necessary with jovoto as mediator. jovoto will provide a specimen agreement on request.

4.13    The granting of rights of use in accordance with section 4 remains unaffected by the termination of the contractual relationship between the creative and jovoto and the underlying terms of use.

5.    Creative's Guarantee, Indemnity

5.1    The creative guarantees that he has developed all ideas, and works associated with the ideas together with the individual elements, himself, and that he is the owner of all rights that are necessary in order to grant the rights of use in accordance with sections 3 and 4 and to meet any other applicable conditions. The creative also guarantees that his ideas and associated works are free of any third-party rights.

5.2    The creative also guarantees that he will not submit or offer any content, in particular ideas or work samples, that encroach upon the rights of third parties or where content is ineligible in accordance with the above provisions. The creative must check whether his ideas and the associated works infringe the rights of third parties. Indications for such contractual infringements are given when, in particular,

5.2.1    Works subject to copyright, e.g. graphics, videos, photos or text (even when edited or alienated, unless the original can no longer be identified), are used that were not created by the creative himself;

5.2.2    The ideas contain performances subject to copyright or related rights such as live recordings of concerts, plays, circus performances, etc., or parts thereof, or include other performances protected by other related rights such as television programs (including opening and closing sequences);

5.2.3    Third parties have collaborated on the production of the content in such a way that they are able to acquire ancillary copyright, for example for recording, direction, editing, sound engineering, camerawork, etc. unless the persons in question have agreed to the exploitation of the idea created with their collaboration on the platform;

5.2.4    The content includes personal or other sensitive information about individuals or groups of people, unless the necessary consent and/or exploitation rights have been obtained by the creative;

5.2.5    Third parties are portrayed in photographs or videos in such a way that they play a major role in terms of their significance for the photo/video, unless the creative has obtained their explicit consent to the scene and to the exploitation of the results on the platform.

5.3    The creative also guarantees that he is not prevented by any contract of employment or other such agreement from contributing the relevant idea and participating with it in a project.

5.4    The creative will indemnify jovoto from any claims that third parties may assert against jovoto for infringement of their rights as a result of the ideas submitted by the creative. jovoto will inform the creative of any such assertion in writing immediately. The creative will make every effort to support jovoto in preparing a suitable defense. The creative will assume all costs incurred by jovoto in this connection, including reasonable costs for a legal defense. The creative is entitled to prove that the actual costs incurred by jovoto were lower than those claimed.

5.5    The same applies in the event of claims asserted by third parties when the creative infringes legal positions of third parties, in particular trademark rights or personal rights, or other legal provisions (such as prohibitions contained in the Act Against Unfair Practices – UWG) through the subject of the content, irrespective of the authorship thereof.
