Established in 1921 by Leonowitsch Gorbatschow in Berlin, Wodka Gorbatschow has gone on to become one of the most successful spirits in Germany. Its iconic bottle and typical blue and silver label have become a symbol of vodka itself.

Wodka Gorbatschow is synonymous with exceptional quality, pureness and mildness –achieved by the unique and patented quadruple-chill filtration process.

The dove on the label symbolizes Wodka Gorbatschow’s purity. The TV commercial, which is very well known in Germany, conveys the clarity and purity of the spirit, expressed by an icy-cold polar world associated with the brand’s claim:

Wodka Gorbatschow plans to launch the coolest limited edition bottle on the market – with the help of your imagination, creativity and design expertise!

Task Definition

Wodka Gorbatschow is inviting you, whether you’re a design amateur or professional, to create the next limited edition bottle of their legendary vodka.

The challenge for the Client’s Choice Amateur Award
Create the most amazing Wodka Gorbatschow limited edition.

Use the templates provided to create your Wodka Gorbatschow design in the "Download Material" section. You can choose which parts of the bottle you would like to design.

  1. the design on the bottle itself
  2. the two labels
  3. the lid

You can decide whether you design one part or combine multiple parts.

If licensed, your design will be technically adapted and made possible by the client with various printing techniques (screenprinting for on-bottle creations, and pretty much any type of printing for on-label and on-lid design).

Your design must be inspiring, sophisticated and invoke desire in the consumer target group. The following typical elements can help you set the Wodka Gorbatschow brand in scene:

  1. the ice
  2. the arctic world
  3. the colors blue, white and silver

The challenge for the Client’s Choice Professional Award
Wodka Gorbatschow is planning on producing a limited edition of the most stylish idea, but only on the condition that the chosen idea is also feasible from a technical perspective. If you are aiming for the Client’s Choice Professional Award, you must consider the Technical Design Requirements provided in the “Download materials” section below "Material for Professionals".

To give you, the "Professionals", a hand, we've prepared a tutorial (available in the Download Materials section) with do's and don'ts when designing for printing on the bottle and on the labels. We encourage the "Amateurs" to check it out as well, just in case they might be curious. 
Also you will receive expert feedback that will help you to optimize the feasibility of your idea.

Please note! The shape of the bottle, labels and lid channot be changed. Nor can the actual glass of the bottle.

Mandatory requirements

  • The Wodka Gorbatschow brand must be visible
  • The words “Limited Edition” must be integrated into your design
  • To ensure a full view of your design, make sure to upload your submission attachments in square or landscape formats. If you are working directly on the "Clean Bottle" template, you can do so by adding a background that has the same or a bigger width than the current height of the template.
  • There is no guideline as to whether you depict the content with photographic or purely graphic elements. But in both cases you should only use images and fonts:
  1. for which you own the full copyright
  2. for which the exclusive rights can, if required, be passed on to the client.

If 2. applies, please clearly highlight the third-party image material.

  • For the Client’s Choice Amateur Award, you are welcome to supply any design format, anything from a hand-drawing to a photo-realistic design
  • For the Client’s Choice Professional Award, the winner will have to provide open 2D or 3D files

Halftime Feedback

Dear Creatives of the World,

We had such an inspiring meeting yesterday with the client at the gorgeous Henkell headquarters in Wiesbaden. Here is our colleague, Conradin. ;)

They want to send you a big thank you for going through the brief (some of you through the detailed technical info), and for participating with your submissions, comments and good vibes in this challenge for the next Wodka Gorbatschow Limited Edition.

There are 4 weeks left. That is enough time to come up with new designs and take your current work to the next level.

Here’s what you need to know:

  • Make sure to also upload one visual with – the bottle and your new design on a white background

Backgrounds are great to present your concept, but they can be misleading. It is very important for the client to see exactly how the bottle and its design looks like, free from any background noise just as the client will see it on the shelve.

And,  in order to pick the right design, the client will have to perform some market research. To do that, they will need to show comparable visuals (the design on white background) to the target group.

  • Avoid historical and other references to the roots of Wodka Gorbatschow

Please avoid any reference to Russia, the revolution and its founder. Let’s focus on the Arctic, the dove, and all the beautiful things that a night out brings.

  • The “wow” effect!

You are working on a “Limited Edition”, so make this aspect very clear with your design and text on the bottle. When the customers see it, they should immediately get the “wow” feeling. They should know in the first second that this is a “limited edition”, rather than wondering if this is a new flavour from Wodka Gorbatschow.

Make sure that your design stands out in terms of uniqueness and prowess, and that it communicates quickly and clearly what it should.

  • When coming up with completely new colors, think if your design would still be clearly recognized as Wodka Gorbatschow​

As a groundcheck of the strength of your work, think if your design would stand as unique and as strong in the colors dark blue, white and silver. To be on the safe side you can upload an additional visual featuring your design in the Wodka Gorbatschow colours.

Define "designer"...? People like me prefer to work without fancy schmancy 3D whatever, and use the printed part to get our point across.

I was waiting for the project to be opened, and now I'm really disappointed: the purpose is NOT to redesign the bottle? Because all indicated that it would be a bottle design... Especially when you classify it as a packaging design project, it implies structural changes... if you state also "Create the coolest limited edition bottle", it naturally implies that the bottle will be redesigned, and not just the label...

Absolut never changed the bottle for their limited editions...? I do not see how that is a given.

Wait, I think they occasionally added bling.... but the shape itself was always the same. Maybe stretch this project a bit, too, by playing with textures and materials?

However, there is so much to do without changing the shape of the bottle, not only in terms of actual design, but also in terms of printing techniques on the bottle and on the label. I hope you will get excited and inspired about it nonetheless and participate.

Diana, I'm an industrial design professional. Therefore, I'd not be interested in participate in a graphic design only challenge... my critic is actually more on jovoto platform than on the client's brief itself, since jovoto doesn't separate two totally different kinds of project. At this very moment we have here a project that's also labeled as "packaging design", in which only the structural shape will be changed... they're rather different universes, they should be clearly separated as they are in real life.

@CrossTheLime, absolut has also some brilliant examples of strucurally different limited editions: the "bling" you're referring to was a plastic case, enclosing a traditional bottle. There are also the miniature sets, textile cases... you don't necessarily need to change the "shape" of the bottle to create something structurally different ;)

However, I agree with you that there is much confusion around these kind of terms, and they are hardly always perfectly encompassing of the actual task.

Thank you for your suggestion. We have a limited number of characters that we can fit in there. But we will do our best next time to double check that the title is not confusing.

That being said, you should always wait for and read the brief. Without the brief no work is relevant. And it's also the best use of your time - read the challenge of the client in detail, and then create. :)

Generally the elements of the logo should stay unchanged. However, you can do a few things, you can play with the elements of the logo in the following way:

– you can separate them and move them around (i.e. the dove can be positioned somewhere else on the bottle)

– you can recreate the logo graphically (i.e. you might make it look 3D, or you might have some amazing illustration talent to put to use).

The important thing is that the logo and, hence, the product stay easily recognizable to the customers. You must imagine that in-store customers will look at the bottle on the shelf for 3-5 seconds and decide if they will walk further or stay to check out the limited edition bottle in more depth.

The idea behind the Client's Choice Professional Award is that the client could directly use your design for production. So they need the source files, be it 2D or 3D, whichever you use. So, 2D is fine. And it is about the label, on bottle and lid – you are free to redesign them all or just one, or two.

Basically, if you are working with a gradient kind of surface that is basically grey, then it counts as one color. If you are using simply different shades of grey for different surfaces, then each counts as a different color. I (and, therefore, the client technical experts) would have to see your actual design to give you precise feedback. I'd suggest to go ahead and upload it, and then we can tell you if it works or not. :)

We thought that you might enjoy to know, throughout the Crowdstorm, which ideas catch the client's eye.

So, if your idea is liked by the client, you will get a notification in the shape of a comment under the idea. It doesn't mean that that idea will be licensed or that it will win something, what it means is that it is on the right track.

And then you can decide for yourself if you want to put more time into finishing the ideas with potential and / or also the ones that did not catch the client's eye, to convince them how awesome those ideas are as well.

Rather a comment, may be some icon like a traffic light? Green means " you idea is in the right track & you can go on!", Red means " stop, you idea is totally out of the right track. Start again." and yellow mean " Hold, you idea have some potential, but, something no right. Inspect it!" What do you guy think?

First, developing things for the website takes time. So we'd have to take your suggestion into consideration for the next Crowdstorms, as it wouldn't be possible to implement right here and right now.

And second, sometimes clients can be wrong too. ;) In the sense that they might not initially see the potential of an idea. So we wouldn't want to go for such a radical approach. But I get what you mean and there are many creative and inspiring ways to get to the same destination.

There is no blind option on Jovoto, as that would go against the whole idea behind the site.

I am not sure that I get what you mean exactly, but CrossTheLime is correct. The projects (Crowdstorms) on jovoto are collaborative and community based. This is why we have the Best Feedback prize (for the most helpful comments) and why we have the voting part that starts once the submission period has ended. I will introduce you all to these details step by step, while the Crowdstorm is running.

Important notice for your image uploads: As you might have noticed, the 2D "Clean Bottle" template that you are using to make your designs is set up vertically, with a very narrow width. If you apply your design directly in that file and upload it as such, your design will not be seen in full in the Idea overview.

– First of all, I need to know if you are applying for the Amateur Award or the Professional Award. Second, could you please share with me an example with what you mean more or less? Maybe you can find something on Google. You can also PM me about it, if you wish.

– It is not necessary, but yes, you can. However, make sure that your design on the bottle also works without the package that accompanies the bottle.

I am sorry but I need to say this platform doesn t work at all. I have sent 4 proposals here. I have got three comments together from other members. Nobody vote and if they vote they don t comment anything. If i check top 100 i can see there projects from same mambers so it means people just vote eachothers or they vote only their friends. . It sucks!!

If member has low karma and he gives 1-2 in case maybe yes it is easily discovered, But if 5 friends(for example school mates) with high karma decide to give 3-5 to some member how you know it is not manipulating. Anyway it would be quite effective way.

It takes a certain karma level for the votes to count, first of all. Plus, Such a behaviour is not so difficult to be traced with enough data.

But, good question, we are actually working on a blogpost to explain, in brief, monitoring behind the scenes. Hopefully we can post it very soon. And, as you know, we are working on ways to eliminate such behaviours.

Hello, Diana! Just some question ... 1. Regarding screen printing stations , is it including the label part? 2. How many maximum colors we can use for the label only (lid, body & round)? 3. For professional , can we design just the label part? Or We must design the printing on the bottle?

Thank you. Printing on bottle is very new to me & i inexperience in it, especially printing on bottle. Can my idea apply on the bottle? How many printing station do i had with my idea? Is the label using the same method as the bottle printing or normal sticker?

I thought I'd quickly jump in to mention a few guidelines on voting in this project, since some of you are already giving votes.

First of all, when you vote an idea in this Crowdstorm, vote it based on the design, and not on the technical feasibility. That's because many of you may have not read the technical requirements. And also because 'design' is where all submissions intersect.

Then: – Be sure to read and consider the creative brief. – Rate using the full scale from 1-10. By giving a diverse range of ratings you broaden the range of ratings and use the full spectrum and power of the rating system. – If you have friends on the platform and you find it hard to be objective, it’s better not to rate their ideas. – The more you rate the fairer the result – more people more opinions. Broader spectrum. – Always be fair and objective! Rate the ideas, rather than the people who submit them – Remember to change your vote if the idea owners has improved his or her idea. Unfair (cheat) votes will be annulled during the monitoring phase.

More or less :) Do you know what is the occasion? Why they want a Limited Edition series? Are they sell one Limited Edition, or a collection in the future?In my opinion this question is very important, because the "artistic" route is good, if they want a collection, but not a good choice if this Limited Edition is exclusive, or different taste, or different manufacture process, or if they want to sell it with double price.

in short: What is the story behind? What is this Limited Edition vodka, What can this product, why Limited :)

Usually, a "Limited Edition" of a product is a moment in time when the product wants to bring a special design on the market, for a limited amount of time. These "Limited Edition" designs are usually collected (or saved) by the customers because of their unique design.

Wodka Gorbatschow, although it has been around for almost 100 years, it has never had a "Limited Edition". So, if all goes well with the first one, they will introduce other "Limited Edition" designs in the future. Most probably the price for it will stay the same. And it does not come with a new flavour.

No. Simply upload them under the same idea. To make it really obvious, you can mention it in your presentation by uploading a slide in between with the text "Color Variation".

Please remember, when you upload your idea to ask yourselves – is what I've uploaded 100% mine? If not, if you've used some stock material (or unlicensed fonts) to create the scene, or for some design details, it is okay, but it is critical that you mention it in the "Credits" field, every time you upload a new attachment, like here, and in the last question of your idea. This will keep you out of legal trouble - here on the site and if your idea get licensed later. It also shows that you are a professional. ;)

I encourage you to rather focus on the graphic design on the bottle, than on the background behind the bottle. Actually it is best if you upload your designed bottle, first and foremost, on a white background. That's good for you not too waste time in the beginning, to get quick feedback, and for the client to see what you are really offering.

I will remind you that, if you are aiming for the Client’s Choice Professional Award, the design you are submitting right here and right now, will have to be technically feasible. For that, it is necessary that you check the: 3d files and exact measurements (from the "Download Materials" section) and the [tutorial](

If you are aiming for the Client's Choice Amateur Award, you are free in your creation, and if your idea wins, then the client will adapt your design technically. However, we encourage you to check out the [tutorial]( for the Pros anyways, just to get inspired.

Here is what you really need to know when you rate an idea in this Crowdstorm:

– Rate the design, and not on the technical feasibility. That's because many of you may have not read the technical requirements. And also because 'design' is where all submissions intersect. – Be sure to read and consider the creative brief. – Rate using the full scale from 1-10. By giving a diverse range of ratings you broaden the range of ratings and use the full spectrum and power of the rating system. – At jovoto we support fair votes, so please do not invite your friends to vote for you. – If you have friends on the platform and you find it hard to be objective, it’s better not to rate their ideas. – The more you rate the fairer the result – more people more opinions. What I have learned during this project. It is no reason to show your work before last day. Now i understand why some members hide their unique ideas always until last minutes. People are free to copy the concepts of the other members and develope them itself because it is ok to project guides. So what is the meaning of the collaboration in this case i wonder.

Hi there,

The reason to submit earlier is to get feedback from the guide and from the community on how to improve the idea. From my experience, it is very rare that an idea is 100% perfect as you submit it. There is some meaningful detail usually always missed, By submitting in the last day or moment, you don't have the time to receive the meaningful feedback, or to update your idea. In this Crowdstorm we had sadly such examples as well.

However, every creative can decide for themselves when they want to submit. And what is important from them.

In what concerns the "copycat", we're looking into it, this is why we didn't yet get back on the issue.

Looking at all ideas after submissions, I had to admit that so many great works coming in at the last few days. Although i not a favor of uploading the idea in the final few days, the works submitted late sometime is better. In the past, the platform even have winners came from the last submission.

It is always interesting, indeed, to see great work coming up either very early in the submission period and very late. :)

I thought to give you the heads up regarding the next steps in this Crowdstorm. Once the voting (by you) has ended and the monitoring has been done (by us at jovoto), we will announce the Community, Best Collaboration and Best Feedback Winners. That will take two to three weeks.

The Client's Choice Amateur Award will be picked by the client based on their favorite 'Amateur' design.

For the Client's Choice Professional Award, the client will pick their favorite 'Professional' designs and check them with their printing agency. After that, they will pick 6-10 designs which will go into a Social Media Voting. This voting will start in about a month. For the exact date & more info, stay tuned to this channel. ;)

In rare cases, we do make exceptions to the rule. In this case, it was reported to us a case of idea interference which we had to deal with after the end of the Crowdstorm. We did not consider the idea a case of plagiarism or a copy, however we did want to pick up on the reporting. We found as the best solution to ask the creative to make a slight update to his idea (a suggestion that we normally give in cases of idea interference during a Crowdstorm), and hence avoid any possible idea interference and keep supporting his wonderful work.

I hope you see it like us as well, and that you can appreciate his work.

Of course you should organize totally new voting if you update works after voting period. Otherwise the whole voting loses its meaning, right?

A big drumroll to the two Client Choice Winners:

The Professional Client Choice Award goes to razorxx and his design Silver print or Neon glow–– it was the most voted idea from the five finalists with more than a third of the votes. We are already very excited to see your limited edition bottle in a few months (in winter) on the shelves. ;)

Very interesting to get to know about all this things ;D I like to know at first, why not choosen an idea from the "amateur pool" of submitted ideas, like the briefing tells! Not okay for me, breaking the rules!

Hi everyone,

I will be happy to quickly clarify the winning idea for the Client's Choice Amateur Award. First of all, the Client Choice is always picked by the client – purely on the submitted idea and, obviously, independently of the creative's status on jovoto (such as having a yellow band).

Secondly, regarding the idea's status – it might look tricky, but it is very simple. Hyper Flix submitted his idea for the Amateur Award. The client really liked it, so when making up the shortlist for the social voting, they checked it with their production agency and they found out that the idea could be produced. So it entered the social voting. Since the idea did not win the social voting, and since the original status was an idea for the Amateur Award, the client found it just perfect for that award.

My words "well done" directed to Hyper Flix were for the fact that, although ending up on a very low rank in the community voting, his submission stood out to the client. So, it is a nice example how, in general, a low ranking idea, my still win the Client's Choice, and even with so many submissions,

It is important to know that, although we had technical experts from the client throughout the crowdstorm, they only checked the ideas applying for the Professional Award, since those were the tricky ones. However, it was not always perfectly accurate to assess if an idea could be produced in some cases - unless this idea was taken to the production agency. Having all almost 300 ideas checked by the agency would have been impossible in the given timeframe and costly. So, we let you give your best go at for which award you think your idea fits, and then we checked the finalist ideas (on the client's list) with the agency. Some of the Amateur ideas may be produceable as well, but since they did not make it on the client's shortlist anyway, they were not checked.

We looked into the shortest and easiest process possible, for such a big crowdstorm.

Hi Diana .Yes,I understand the client motivation but still if someone is already recognised for the professional choice award by client and jovoto shouldn't be a part of Amateur award. By Jovoto's Rules should be two separate shortlists otherwise it is against rules. Why you are creating any rules and separating the submission from the beginning if you are not going to follow it?We didn't create these rules you did. And yes it was a lot of submissions 300 people had worked completely for free which made a nice media campaign again for free for WG. If WG really like Felix work they should pay him the same prize as a Razor because they recognised him for Professional Award already and now they have a person from the professional choice award for the Amateur award money. All is very convenient. I guess better than nothing!Why you didn't create one award, first and second place if the client doesn't really care about these rules. It could have been that any other actually technically produceable idea from the Amateur Award list would have caught the client's attention in a similar way to be included in the social voting, but it didn't. Also, no other idea from the Amateur submissions did they like better than his. I think we should focus on congratulating Felix, and accepting that his idea really stood out.

I agree with you, it goes without saying how much talent and beautiful work we've seen in these many submissions!

I thought Diana that the social voting was for the Proffesional award choice not for Amateur I haven't heard anything about social voting for the Amateur award, and you maybe misunderstood me I don't have anything against Felix work this is a case for a personal test.I think, actually that because he was chosen for the proffesional award social voting if WG like his work so much he should be paid 3000 instead of 1500. And Diana you haven't answered my question I think a big problem here for me is a lack of transparency.If you change the rules at the end of competition, what we suppose to think ?We don't even now who was shortlisted for the Amateur award. You are right,Jo! I think WG didn't want to pay another 3000 E prize ,so they choose to break the rules. For example,in the Greenpeace campain against McDonalds the client choose more then 3 designs ( as it's was initialy said in the briefing),but they were all paid the same. I don't know what understanding was betwen Jovoto and WG, but I think it is not fair to change the rules at the end of the competition. Jovoto should have more respect for their designers,even for the non profesional ones. Anyway,congrats to all the winners and participants!They were all great and deserve better clients to work for! I apologize if I missed any of your questions. You are correct, there was a social voting only for the Professional Award. There was no official shortlist of the Amateur Award - it was simply picked by the client on their own a few days ago based on their internal discussions.

The rules did not change. The two Awards stayed as initially planned. We asked everyone to pick their type of submission, and so you did. The winners were picked through social voting and by the client. One idea happened to be with its feet in both worlds. It could have happened to yours (or any others') as well - and we would have still be open to it. And this openness was also part of the initial setup.

Thank you for sharing your thoughts. I will explain the prize structure at the top.The winning design of the Client’s Choice Professional Award is the design that will be created in winter, the one that will sit on the shelves. The following Award (Amateur) is additional (it might not be produced), and is simply there to give more prizes & acknowledgement to at least another creative. Another & main reason in the different in the amount is that for the Professional Award, the creatives had to dig into the technical specifications and work accordingly. It is only fair to them to pay them more.

It is correct that, in general on jovoto, when a client decides to license and produce more ideas than initially planned, they pay each idea an equal amount. That is not the case here, as explained above.

The openness which you mentioned before it is only for client convenience not for ours.Felix should be paid full amount because he took part in professional award.if someone is taking part in two awards that fact is proof that the rules of this competition changed.

Fact is that jovoto does not follow rules they have done. They follow their rules only if it is good for themself . Of course for customer we are not exist. It is sad bad true.

We asked the creatives to pick their category because we wanted to leave the freedom to the creative if they want to dig deep into the technical specifications (and hence apply for the Professional Award) or they want to simply go ahead and create freely without looking at the specifications (and hence apply for the Amateur Award). That is also another reason why the difference in the award amount – as it does take much more time to check the specifications and work accordingly. So, we left it up to you to choose how you want to work.

I did not participate - but the way I understood it, the difference between amateur and professional was not that only "professionals" had a chance to actually make the final product. The professionals had to worry about technical details, whereas amateurs could just design, and if it went into production, the WG team would alter the design to make it feasible.

The misunderstanding maybe comes from using the word "professional" in combination with the social award...?

Dear Diana, Thank you for your replay. I understand that you can not express an opinion about a Jovoto client because of the policy 'The client is always right'(even when he is not). But I can. In the future clients should not bring up 'Amateur awards' just so they can buy later profi designs at half price. It is not fair for none of the creatives here on the platform. Jovoto should take early measures so everybody can be fair awarded and not tricked by stingy companies. That is my opinion. It is also sugestion for the future projects.

Dear Ana Mateias, there are no tricks, there is no unfairness and for jovoto the creatives and the client are exactly equal. Without any of them, jovoto wouldn't exist – we are very aware of that – and we love you both. :) The difference in the amount of the two Client Choices has been specified twice above and, as explained by CrossTheLime as well, it is related in the difference of effort that need have been put for each submission by the creative. Also the client, if they would, say, produce an Amateur design, they have to rework it in such a way that it fits the technical requirements - which means hiring another designer who works with the technician, whereas with a Professional submission that step would be skipped. I honestly don't see where you see unfairness in this setup.

"good clients would never ask for a spec work. " WTF. Seriously? Then why are you here?

There are some brilliant clients on here, and they are giving me a chance to work on projects that never would have come my way otherwise. I do not have to try and break into agencies or get an agent or pitch (hey that is spec, too) - I can have fun with my peers right here.

Considering the money spent on community pricing, not all that "spec" either.

Luckily, I have no kids. ;) And I do not do only spec work. Often spec work leads to usual commissions. But yes, I can live off what I make.

My 2 cents.. With so many different work models around the world for creatives (agency employee, freelancing, crowdstorming, partnerships & studio ownership etc.), everyone can find their best fit or mix. Let's accept everyone as they are, and with their own choices – they certainly make sense to them at this point in time.

Just to clarify, crowdstorming is not spec work, it is another model for co-creation; with prizes, learning and licensing. It is another variety to the mix. And we are happy that many of you find it thrilling and rewarding. We love you more than you think.

Project terms

The following Project Terms are the legal basis for your participation in this particular project.

In §3 we define the rights that you pass on to jovoto when you submit an idea (for example, you may publish and share your idea on other websites or social media but ensure it is clear it is a submission created on jovoto).

In §4 we define the rights that you pass on to the client (for example, that the client is allowed to evaluate or review your ideas in order to help them make their decision). From §4.2 onwards, you find the details about which rights you pass to the client once the project is completed if they decide to license your idea.

In §5 you will find important points on what you will be held responsible for (like respecting copy rights and clearly marking all third party material in your submission).

Project Terms for the "The Pure Soul of Vodka" Public Project

1.    Scope

1.1    These project terms supplement the Terms of Use for creatives and apply to public projects in terms of section 3.1.1 of the Terms of Use. Definitions contained in the Terms of Use also apply to the context of these project terms. Public projects may be viewed by everyone. All registered creatives may submit ideas for such projects provided they accept these project terms.

1.2    By submitting an idea to the project, the creative accepts the terms of use and these project terms.

2.    Right to be Named as Author

By accepting these project terms and the terms of use, the creative waives any right to be named as author if the client wishes this when licensing the creative's idea. As long as the client does not purchase the idea, jovoto will ensure that the creative is named as author.

3.    Granting Rights of Use to jovoto


By submitting an idea to the project, the creative grants the rights of use listed in section 3 to jovoto.

3.1    Even when participating in a project or submitting an idea, the creative still retains the right, without restriction on content, time or space, to use his own idea for the purpose of self-promotion provided he observes the rights of third parties, in particular those of the client. This does not apply to the first six months following the end of the submission phase of a project. During this period, the creative is not permitted to use his idea in any other manner. The client's trademarks and other related rights may only be used if and when the client explicitly allows this for the performance of the competition. 

3.2    jovoto wishes to point out explicitly that participation in a project and/or submission of an idea does not confer on the creative any right to use material of jovoto or the client. In particular, participation in the project does not give the creative any right to use the logo or other materials belonging to the project sponsor (client) or to third parties. This does not apply in cases where the project terms or the project briefing call for other arrangements.

3.3    The creative submitting an idea to a project grants to jovoto non-exclusive transferable rights, without restriction on time, space or content, to use the idea, including associated creative works and any comments submitted therewith to the extent required for the operation of the platform. In particular, the creative grants to jovoto the right to make every comment and/or idea and the associated works on the platform accessible to third parties and to make any reproductions necessary for this purpose. The creative grants to jovoto the right to edit the works in question in order to present them more favorably on the website.

3.4    In addition, the creative grants to jovoto the right to make comments and/or the idea and the associated works publicly accessible for the purpose of presentation beyond the confines of the project, for example in the jovoto newsletter or in its blog, to distribute them and to edit them, in particular to create and present summaries or individual pictures of videos and texts, scaled-down versions of photographs ('thumbnails') etc.

3.5    Furthermore, the creative grants to jovoto the non-exclusive right, without restriction on content, time or space, to use the ideas and associated works in any medium for the purpose of communicating and promoting the project and/or ideas submitted to the project. To this end, jovoto may reproduce the ideas and associated works, distribute, edit, rearrange them, make them publicly accessible, broadcast and publicly play them in other ways, whereby this includes in particular making them available or broadcasting them by transmitting the content to fixed or mobile terminal devices of other creatives as part of automated subscription services (push services) or download services (pull services) (e.g. by podcast, RSS feed, Atom feed, XML interface or other technologies). The parties to this agreement consider the right of public reproduction also to include, in particular, the right to render the idea and associated works on the website using methods to play back audio and video data that can be received and simultaneously played by creatives (streaming), including the possibility of configuring the stream in such a way that the broadcast data can be stored by the recipient. In order to document the project and/or to promote the platform, jovoto may in particular include the creative's idea, alone or together with the ideas of other creatives, in a catalog of ideas, which will be made available to the client on conclusion of a project, and which it may reproduce as a different form of print publication and distribute (including as poster), where this serves as an appropriate form of publication for the platform, present at trade fairs (in particular in the form of banners, posters, video clips), make accessible as "best cases" on the platform, also in conjunction with other projects, or make generally publicly available, include in press releases or make available to third parties in the course of normal public relations work (for example for external press reports in journals).

3.6    In order to secure the greatest possible level of awareness and reach for the creative's ideas, the creative additionally grants to jovoto the right to publish the creative's ideas, and/or to have them published, on websites of external providers, to make the reproductions required for this and to transfer the individual works (i.e. the corresponding files) to the relevant third party, and/or to grant these providers technical access to the ideas for the above-mentioned purposes, including the right to reproduce the ideas for inclusion in their own websites. In order to achieve the aims mentioned in this sub-section, jovoto may use popular, established technical methods (e.g. embedded functions). The creative therefore consents to the relevant third-party provider adopting the works in question and also publishing them.

3.7    The creative will receive no monetary recompense for granting the aforementioned rights of use to jovoto. In return for being granted the rights, jovoto will present the creative's ideas on the platform and will give him the opportunity to sell his ideas to third parties or to jovoto and to participate with his ideas in projects.

3.8    In technical terms, the platform is a highly complex system with a large number of links. The content of creatives builds on from different user content and is cross-linked with it in many ways, etc. In addition, as a platform for creative services, the platform must provide a high degree of transparency and traceability – also covering the possibility of investigating or searching through events set in the past. The granting of rights of use in accordance with section 3 is therefore irrevocable and extends beyond any end to the user agreement. Content submitted by the creative to the platform can therefore remain accessible on the platform even after this license agreement terminates or the creative is no longer a user of the platform for other reasons.

3.9    jovoto also endeavors wherever possible to allow the creative every freedom to exploit his ideas vis-à-vis third parties. Within the scope of projects the creative may, where applicable, have the opportunity to subject his idea to open content licensing terms (such as Creative Commons licensing). Whether and to what extent this is to apply in an individual project (including the relevant details) will be specified in the briefing. The creative must in all cases explicitly indicate the use of third-party materials, including those that are subject to open licensing.

4.    Granting Rights of Use to the Client


By submitting an idea to the project, the creative grants the rights of use listed in section 4 to the client. The granting of rights of use in accordance with section 4.2 ff. is subject to the condition precedent that the client decides to acquire the creative's idea.

4.1    By participating in a project, the creative grants to the client the non-exclusive right of use, without restriction on content, time or space, to present his ideas and works as such outside of advertising campaigns or in order to promote the project, alone or together with the ideas and works of other creatives participating in the project, in any medium. Moreover, the creative grants to the client the right to use the ideas and works for the purpose of internal and external market research and for preparing the acquisition of the exclusive rights of use to the ideas and works. This may require the distributing and making the ideas and works publicly accessible, limited to the aforementioned purposes.

4.2    By accepting this license agreement, the creative grants to jovoto, subject to the condition precedent of the client's decision to acquire the corresponding rights from jovoto, rights of use to the idea that the creative has submitted to the project, together with all works, performances and activities contained in the idea, and to elements protected by copyright, design and performance protection rights associated with the idea (hereinafter referred to collectively as "works"), for exploitation in all known and unknown manners of utilization, in particular to the extent detailed below. This includes in particular – also in cases where rights arise at a later date – the exclusive, transferable right, unrestricted by content, time and space, and capable of being sub-licensed in parts, to reproduce the idea, and all works, performances and activities contained in the idea, irrespective of whether for payment or not, to distribute them, exhibit, rent out, to publicly render, in particular present, perform, display, make publicly accessible, broadcast, relay via cable or other systems (cable rebroadcasting), reproduce through video or audio medium, to make public via screen, loudspeaker or any other technical device, programs already broadcast or recordings made on the basis of public transmissions or to reproduce in any other intangible form, to edit and rearrange as well as to publish and use any such edited or rearranged form.

4.3    The aforementioned rights of exploitation for commercial or promotional purposes include in particular:

4.3.1    The right to reproduce the idea, and all works, performances and activities contained in the idea, in any tangible and/or intangible, digital or analog, form, e.g. through reprography or transfer to analog media (e.g. packaging, promotional material, advertisements, placards, books, stickers, printouts, pictures, illustrated books, books, comics, leaflets, flyers, photographs, photocopies, photo-mechanical processes, posters, magazines, newspapers), through digitalization or any other form of digital storage and to temporarily and/or permanently store on any other known type of data, video and/or video/audio media such as diskette, DVD, DVD-R, DVD-RW, DVD-RAM, HD DVD, Blu-ray Disc, CD-ROM, CD-R, CD-RW, CD-Audio, Super Audio CD, audio cassette, vinyl record, MMC, SD, MS, MS Pro, Flash Card, Smart Card, Secure Digital Card, memory stick, MiniDisc, DAT, hard disk, server, proxy server, USB stick and/or via transmission in the Internet or other data networks or through transmissions or in database systems; in particular this also includes the right to use the idea and all works, performances and activities contained in the idea for company-internal and -external presentations, in company-internal media such as intranet, PowerPoint presentations and for the creation and distribution of advertisements in print media and in electronic, especially online, means of advertising;

4.3.2    The right to distribute or put into circulation the idea and all works, performances and activities contained in the idea in any known way and on all physical analog and digital media independently or in combination with other works, especially in support of a product, and/or to offer these to third parties, in particular to rent and lend out irrespective of the distribution channel and the embodiment, in particular through distribution of the idea and all works, performances and activities contained in the idea on the aforementioned digital or analog media via wholesalers, resellers or retailers, mail order and irrespective of whether by remote sale, electronic transaction, free transfer or free distribution;

4.3.3    The right to transfer the idea, and all works, performances and activities contained in the idea, in any known technical manner and to make them known, and in particular accessible to the public. This includes, in particular, the fact that the idea and the associated works may be stored in digital form in a data processing system from which they may then be retrieved by third parties 'on demand' as a stream or download or any other form as digital signal via wired or wireless media and/or transmitted there with the consequence that the stored data are transferred to the receiving device of the third party where they may be decoded after storage, intermediate storage or immediately, i.e. converted into text, images and/or sounds and made visible or audible. The idea and the associated works may also be made available to the third party in such a manner that he/she may store the idea and the works contained therein and/or parts thereof in his/her receiving device and may access them there repeatedly. Interactive use by way of on demand is characterized by the ideas stored in digital form being made available to members of the public who are not present at the source of where they are made available, and being made available in such a way that members of the public have access to them and can request their transmission at independent times and places even if transmission of the works to third parties takes place at a later point in time than at the one requested. The online right of use exists independently of the form of transmission chosen by the client or its licensees for the use of the protected material and includes, for example, interactive or non-interactive online systems, electronic databases, the Internet, the World Wide Web, social networks and platforms such as YouTube, Twitter, XING, Google+, LinkedIn or Facebook, Apps, IRC or news, file sharing or application service providing;

4.3.4    The right to send or forward the idea, and all works, performances and activities contained in the idea, to third parties irrespective of whether in 'analog or digital' form whether via data networks in the form of subscription or download services (e.g. by streaming, video-on-demand, near-video-on-demand, podcasting, webcasting, simulcasting, IPTV, mobile TV, push services (such as RSS feed, XML interface, etc.) and pull services of all kinds) or via traditional modes of transmission such as public or private broadcast, rebroadcast and repeat broadcast via radio, television and similar systems of communication and reception, electromagnetic waves, electronic devices, wire, cable, satellite, antenna systems, digital means of communications and other technical equipment, whether via the client's own means of transmission or via public or private broadcast companies;

4.3.5    The right to publish the idea, and all works, performances and activities contained in the idea, first in any desired form at the point in time of the client's choosing irrespective of whether on any type of tangible media or in intangible form (e.g. on the Internet), irrespective of whether independently or in combination with other content such as a collection or multimedia work or as part of an encyclopedia;

4.3.6    The right to commercially exploit the idea, and all works, performances and activities contained in the idea, through the manufacture and sale of goods of all types (e.g. dolls, toys, stuffed animals, sports articles, household, bathroom and kitchen items, garments, printed matter including comics, sound storage media, headgear, buttons) and/or to exploit the media listed and described in this sub-section, the marketing of services of all types using the circumstances, names, titles, figures, illustrations or other relationships related to the idea, and all works, performances and activities contained in the idea, including the right to exploit the idea fully or in part through the production and sale of games/computer games, including interactive computer games, and/or other multi-media productions and/or other forms of work and to promote goods and services of any kind using such elements or through edited or unedited excerpts from videos ("merchandising right");

4.3.7    The right to modify, edit, combine, arrange the idea, and all works, performances and activities contained in the idea, in any manner, especially through correction and translation into any other language, through extension, conversion, augmentation, adaptation, complementing, through inclusion in databases or by the creation of collected works, through the substitution of images and figures, through changes to the characters of figures, or allowing such actions to be undertaken by third parties, and to publish, exploit, or have published and exploited, the edited or rearranged works in any of the ways described in the above provisions.

4.3.8    The rights granted exist irrespective of the technology used as the basis for the use of the right. In particular, the granting / transfer of rights of use are not bound to the form of data transmission (analog or digital), to the means of data transmission currently used or to the type of end-user receiving device. The client is especially entitled to allow this access via any type of equipment or device that is technically able to call up and/or represent the content provided. Access can be effected in particular with the aid of fixed devices (e.g. personal computer, set-top box for digital TV or Internet terminal) and mobile terminal devices, especially mobile telephones (via WAP, SMS, i-mode and any future standards), smartphones, electronic organizers, so-called personal digital assistants (based on operating systems such as Stinger, EPOC, Palm OS, Windows CE/Pocket PC), in particular via wired connections (telephone networks, TV cable networks, ISDN, DSL, Internet fixed line, etc.), via wireless connections (wireless local loop, satellite, radio [in particular DVB-H], mobile telephone networks [GSM, CDMA, HSCSD, GPRS, 3G, UMTS], wireless LAN) or in the process of synchronization with other electronic devices (e.g. via cable and network connection, Bluetooth or infra-red) and on the basis of various transmission standards and presentation formats (e.g. TCP/IP, SMS, MMS, EMS, PMS, smart messages, DVB, HTML, WML, cHTML, e-mail) in all online services, data and (tele-) communications networks, in particular the Internet.

The client is to be able to use the idea fully and exclusively on a permanent basis and to exploit it commercially, in particular for advertising purposes and across all media.

4.4    In addition to, and above and beyond, the above provisions, it is agreed that, if the creative has created a computer program, only the client will be entitled to exercise any proprietary rights to the computer program after the transfer of rights by jovoto.

4.5    Following the transfer of rights, the client is entitled at its own discretion and without the separate agreement of the creative, to transfer the rights listed in section 4 to third parties or to allow third parties to exercise such rights irrespective of whether in the original form or in an edited form. This applies independently of the content and scope of the license terms agreed with the relevant third party, i.e. irrespective of whether through the transfer of the exclusive right of use or through the assignment of individual or several fully inclusive or non-exclusive rights of use limited with regard to content and/or time and/or space.

4.6    The above provisions also apply in the event that the idea, and all works, performances and activities contained in the idea, have been combined with third-party protected material. If a collective creative work with shared copyright ownership has resulted from the combination of the works with other protected material, the creative herewith agrees to the exploitation of the collective work to the extent specified by the above provisions.

4.7    The use of material covered by open access or open content licensing terms for the development and creation of the project idea is prohibited, irrespective of whether this is done by the creative or third parties. The creative warrants that he will not use such material.

4.8    The idea will also remain visible on the platform even after being sold to the client. It will however be marked as 'sold (e.g. as 'Client's Choice').

4.9    The creative waives his right to be named as author in the exploitation of the idea. jovoto will work towards persuading the client that the creative's authorship should be acknowledged as author and that he should be named as such in accompanying material in cases where it is not possible to achieve such mention on specimens of the work.

4.10    Where the creative has used material and/or works of third parties in the course of developing and submitting the idea (for example photographs from publicly accessible databases, fonts, sample texts or similar), he also grants to jovoto and to the client rights of use to this third-party material and to these third-party works in accordance with the provisions of section 4.10. The sole exception to this are those parts of the idea that have been identifiably used for illustrative purposes and are marked as such components used solely for illustrative purposes and are explicitly titled as "SAMPLE" or "SPECIMEN" in the idea. Third-party materials and third-party works that are not marked as such will be treated as if they were the creative’s own works.

4.11    The condition precedent for the granting of rights in accordance with section 4 will be deemed to have been met when the client has made the decision to acquire the rights to an idea of the creative as specified in section 4, the client has informed jovoto of this in writing and jovoto has accordingly informed the creative in writing. jovoto will grant the license rights to the idea to the client immediately after the condition precedent becomes effective and the creative has been informed.

4.12    jovoto will immediately inform the creative in writing in cases where the client desires a direct license of rights from the creative. The creative and the client can then reach an agreement on the scope of the rights granted – if necessary with jovoto as mediator. jovoto will provide a specimen agreement on request.

4.13    The granting of rights of use in accordance with section 4 remains unaffected by the termination of the contractual relationship between the creative and jovoto and the underlying terms of use.

5.    Creative's Guarantee, Indemnity

5.1    The creative guarantees that he has developed all ideas, and works associated with the ideas together with the individual elements, himself, and that he is the owner of all rights that are necessary in order to grant the rights of use in accordance with sections 3 and 4 and to meet any other applicable conditions. The creative also guarantees that his ideas and associated works are free of any third-party rights.

5.2    The creative also guarantees that he will not submit or offer any content, in particular ideas or work samples, that encroach upon the rights of third parties or where content is ineligible in accordance with the above provisions. The creative must check whether his ideas and the associated works infringe the rights of third parties. Indications for such contractual infringements are given when, in particular,

5.2.1    Works subject to copyright, e.g. graphics, videos, photos or text (even when edited or alienated, unless the original can no longer be identified), are used that were not created by the creative himself;

5.2.2    The ideas contain performances subject to copyright or related rights such as live recordings of concerts, plays, circus performances, etc., or parts thereof, or include other performances protected by other related rights such as television programs (including opening and closing sequences);

5.2.3    Third parties have collaborated on the production of the content in such a way that they are able to acquire ancillary copyright, for example for recording, direction, editing, sound engineering, camerawork, etc. unless the persons in question have agreed to the exploitation of the idea created with their collaboration on the platform;

5.2.4    The content includes personal or other sensitive information about individuals or groups of people, unless the necessary consent and/or exploitation rights have been obtained by the creative;

5.2.5    Third parties are portrayed in photographs or videos in such a way that they play a major role in terms of their significance for the photo/video, unless the creative has obtained their explicit consent to the scene and to the exploitation of the results on the platform.

5.3    The creative also guarantees that he is not prevented by any contract of employment or other such agreement from contributing the relevant idea and participating with it in a project.

5.4    The creative will indemnify jovoto from any claims that third parties may assert against jovoto for infringement of their rights as a result of the ideas submitted by the creative. jovoto will inform the creative of any such assertion in writing immediately. The creative will make every effort to support jovoto in preparing a suitable defense. The creative will assume all costs incurred by jovoto in this connection, including reasonable costs for a legal defense. The creative is entitled to prove that the actual costs incurred by jovoto were lower than those claimed.

5.5    The same applies in the event of claims asserted by third parties when the creative infringes legal positions of third parties, in particular trademark rights or personal rights, or other legal provisions (such as prohibitions contained in the Act Against Unfair Practices – UWG) through the subject of the content, irrespective of the authorship thereof.

6. Deliverables

In case you are applying for the Client’s Choice Amateur Award and your idea is chosen by the client to be licensed you will receive 1.500€ for any delivered file format. If you are applyling for the Client’s Choice Professional Award and your idea is chosen by the client to be licensed you will receive 3.000€. In order to receive the prize money you need to deliver open 2D- or 3D-Data of your design.
